STATE OF MINNESOTA

AN ORDINANCE AMENDING THE HOWARD LAKE ZONING

ORDINANCE TO INCLUDE “HEALTH CARE FACILITY” AS A CONDITIONAL USE IN THE B-1 GENERAL BUSINESS DISTRICT.

THE CITY COUNCIL OF HOWARD LAKE ORDAINS:

Section 1. Chapter 2, Section 2 (Definitions) of the Howard Lake Zoning Ordinance is hereby amended to include the following definition:

Health Care Facility: A state-certified or licensed facility or institution, whether public or private, principally engaged in providing services for health maintenance, diagnosis or treatment of human disease, pain, injury, deformity or physical condition that provide for overnight stays, including, but not limited to, a general hospital, special hospital, mental hospital, public health center, diagnostic center, treatment center, rehabilitation center, extended care facility, skilled nursing home, nursing home, intermediate care facility, chronic disease hospital, maternity hospital, dispensary, and bioanalytical laboratory or central services facility serving one (1) or more such institutions. Health Care Facilities are not inclusive of medical or dental clinics or offices intended for daytime visits or state licensed residential care facilities.

Section 2. Chapter 70, Section 4 (B-1 General Business Conditional Uses) of the Howard Lake Zoning Ordinance is hereby amended to include the following use:

Health Care Facility, provided all structures excluding fences must be 100 feet from any residentially zoned or guided property.

Section 3. This ordinance is in effect upon publication.
