NOTICE OF VOLUNTARY MORTGAGE FORECLOSURE SALE
Date: May 26, 2008
YOU ARE NOTIFIED THAT:
1. A default has occurred in the conditions of that certain statutory mortgage assignment of leases and rents and security agreement executed by Buy Builder Direct, Inc., a Minnesota corporation, d/b/a Jeff Johnson Homes, as Mortgagor, in favor of FCC Acquisition Corp., a Minnesota corporation, as Mortgagee, dated October 6, 2006, and recorded on October 11, 2006, as Document No. 1028902, as subsequently assigned to Highland Bank, a Minnesota banking corporation, pursuant to that certain security agreement and assignment of mortgage dated October 6, 2006, and recorded on May 9, 2008, as Document No. 1087858, all in the office of the County Recorder in and for Wright County, Minnesota (collectively, “Mortgage”). The land described in the Mortgage is not registered land.
2. The original or maximum principal amount secured by the Mortgage was: $172,500.00.
3. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.
4. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage and all notice and other requirements of applicable statutes.
5. At the date of this notice, the amount due on the Mortgage is: $189,821.57.
6. Pursuant to the terms and conditions of that certain voluntary foreclosure agreement dated effective May 14, 2008 (“Agreement”), the Mortgage shall be foreclosed, and the land described as follows:
Lot 2, Block 2, Martin Farms (“Property”),
shall be sold by the Sheriff of Wright County, Minnesota, at public auction on July 1, 2008 at 10:00 a.m., at the Wright County Sheriffs Office: 10 2nd Street NW, Room 170, Buffalo, NM 55313-1197.
7. The time allowed by law for redemption by Mortgagor or Mortgagor’s personal representatives or assigns is two (2) months after the date of sale.
8. Each holder of a junior lien on the Property may redeem in the order and manner provided in Minnesota Statutes § 582.32, Subd. 9, beginning after the expiration of Mortgagor’s redemption period as set forth herein.
9. The Mortgagor released from financial obligation on the Mortgage is: None.
