Lester Prairie City Council Minutes

APRIL 12, 2004

The Lester Prairie City Council met in regular session on Monday, April 12, 2004. Mayor Angvall called the meeting to order at 7:00 p.m..

Motion – Bruckschen; Second – Foust; Carried – Unanimously; To accept and approve the March Minutes as submitted.

Motion – Hoof; Second – Bruckschen; Carried – Unanimously; To accept and approve the March Treasurer’s Report as submitted.

Councilmember Hoof introduced the following resolution and moved for its adoption:

RESOLUTION NO. 16-04 A RESOLUTION ACCEPTING A 1997 TANKER. The foregoing resolution was duly seconded by Councilmember Anderson and following discussion thereon, a vote was taken.

Mayor Angvall declared Resolution No. 16-04 adopted by a unanimous vote this 12th day of April, 2004.

Motion – Bruckschen; Second – Anderson; Carried – Unanimously; To issue a Special Use Permit to Albin Greshowak Jr. to operate a motorized golf cart on city streets with the same stipulations and requirements as previous years.

Mayor Angvall introduced the following resolution and moved for its adoption:

RESOLUTION NO. 17-04 A RESOLUTION ACCEPTING RESIGNATION OF PART-TIME OFFICER The foregoing resolution was duly seconded by Councilmember Bruckschen and following discussion thereon, a vote was taken.

Mayor Angvall declared Resolution No. 17-04 adopted by a unanimous vote this 12th day of April, 2004.

Motion – Angvall; Second – Hoof; Carried – Unanimously; To hire Brenda Conzet as a part-time police officer for the City of Lester Prairie.

Motion – Angvall; Second – Bruckschen; Carried – Unanimously; To give Officer Paul Schermann his annual pay increase as previously agreed.

Councilmember Foust introduced the following resolution and moved for its adoption:

RESOLUTION NO. 18-04 A RESOLUTION ESTABLISHING A RENTAL DWELLING INSPECTION FEE The foregoing resolution was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken.

Mayor Angvall declared Resolution No. 18-04 adopted by a unanimous vote this 12th day of April, 2004.

Motion – Angvall; Second – Bruckschen; Carried – Unanimously; That Assistant Clerk Darla Simon should attend the Solid Waste Management Workshop held on April 20th. That the City will remain with the plan the City already has in place for 2004 and McLeod County can take over the appliance recycling for 2005. Under the County plan, the City wants appliance recycling held on a Saturday, the County can determine the location, hours of operation as well as provide the manpower when their plan is implemented. It also needs to be determined that for 2004, will the City be reimbursed for the full cost of the appliance disposal that they pay to the hauler or will the City have to collect the full cost of the disposed appliances from those utilizing the service or what is the reimbursement plan for 2004.

At 8:00 p.m., Mayor Angvall opened the public hearing for Prairie Ridge Second Addition Final Plat. The purpose of the public hearing was to receive public input regarding the subdivision of Outlot D as owned by David Segal, Enterprise Properties as well as the zoning of the property as an R-1 District, Single and Two family Dwellings and variances.

Mayor Angvall closed the public hearing at 7:18 p.m.

Councilmember Hoof introduced the following resolution and moved for its adoption:

RESOLUTION NO. 19-04 A RESOLUTION FOR SUBDIVISION, FINAL PLAT APPROVAL AND VARIANCES. The foregoing resolution was duly seconded by Councilmember Anderson and following discussion thereon, a vote was taken.

Mayor Angvall declared Resolution No. 19-04 adopted by a unanimous vote this 12th day of April, 2004,

Councilmember Hoof introduced the following Ordinance and moved for its adoption:

ORDINANCE NO. 238 AN ORDINANCE AMENDING CHAPTER 5, SECTION 5.1.16.687, SPECIFICALLY ZONING MAP, EXHIBIT “A”, LEGAL DESCRIPTION OF THE PROPERTY DESIGNATING THE SAME IN THE PARTICULAR DISTRICTS OF THE MUNICIPAL CODE. The foregoing ordinance was duly seconded by Councilmember Anderson and following discussion thereon, a vote was taken.

Mayor Angvall declared Ordinance No. 238 adopted by a unanimous vote this 12th day of April, 2004.

Motion – Foust; Second – Bruckschen; Motion – Failed: The City follow the liquor license violation policy as adopted on March 10, 2003.

Motion – Hoof; Second – Anderson; Carried – Unanimously; That Mr. Ed Groff, dba: The PortHole be fined $500.00, with $250.00 being suspended, for a liquor license violation of selling alcohol to a minor. $250.000 is being suspended as a result of the cooperation of the parties involved, the fact that the alcohol compliance checks have passed, that there have been no previous problems and there was only one minor involved in the incident.

Motion – Anderson; Second – Hoof; Carried – Unanimously; To hire the following as recommended for 2004 pool staff: Co-Managers – Vanessa Schwanke and Holly Wilson; Assistant Manager – Katie Madsen; Instructors: Vanessa Schwanke, Holly Wilson, Katie Madsen and Chris Hubert; Lifeguards – Vanessa Schwanke, Holly Wilson, Katie Madsen, Chris Hubert, Nicole Erickson and Amy Birkholz; Basket/Concession Workers – Jennifer Otto, Rachel Schwartz, Nicole Horsman, Alex Millerbernd, Jessica Pruden and Maria Anderson.

Motion – Bruckschen; Second – Anderson; Carried – Unanimously; To pay the claims as submitted.

Mayor Angvall adjourned the meeting at 10:15 p.m..
