Lester Prairie City Council Minutes

The Lester Prairie City Council met in regular session on Monday, May 10, 2004. Mayor Angvall called the meeting to order at 7:00 p.m.

Motion - Foust; Second - Bruckschen; Carried - Unanimously; To accept and approve the April Minutes as submitted.

Motion - Hoof; Second - Anderson; Carried - Unanimously; To accept and approve the April Treasurer’s Report as submitted.

Motion - Foust; Second - Hoof; Carried - Unanimously; To issue a 3-day 3.2 malt liquor license to the LongHorn Days Committee for June 18-20, 2004.

Councilmember Hoof introduced the following Ordinance and moved for its adoption: ORDINANCE NO. 240 AN ORDINANCE AMENDING CHAPTER 4, SECTION 4.2 SNOWMOBILE REGULATIONS, OF THE LESTER PRAIRIE MUNICIPAL CODE, SPECIFICALLY REPEALING SECTION 4.2 AND REPLACING IT WITH THE FOLLOWING SECTION 4.2 REGULATIONS OF SNOWMOBILE, ALL TERRAIN VEHICLE AND OFF-HIGHWAY MOTORCYCLE ORDINANCE FOR THE CITY OF LESTER PRAIRIE

Mayor Angvall declared Ordinance No. 240 adopted by a unanimous vote this 10th day of May, 2004.

Motion - Anderson; Second - Hoof; Carried - Unanimously; That the $1,500.00 donation made in 1999 from the Fire Department to the City be returned to the Fire Department Relief Association, not out of disrespect, but rather the City is unable to utilize the funds as designated for a Firemen’s Park.

Motion - Anderson; Second - Hoof; Carried - Unanimously; To hire Neil Otto and Kathleen Otto as lifeguards for the 2004 season.

Motion - Hoof; Second - Foust; Carried - Unanimously; To hire Mollie Phiel as a lifeguard since physician’s permission has been received stating she is able to fulfill the job requirements.

Motion - Anderson; Second - Bruckschen; Carried - Unanimously: To accept and approve the job descriptions for pool manager, lifeguard, water safety instructor and basket/concession stand worker.

Motion - Hoof; Second - Bruckschen; Carried - Unanimously; To allow CAPP to use the open park shelter for music in the park on June 29th, July 13th & 27th, and August 10th & 24th.

Motion - Angvall. Second - Foust; Carried - Unanimously; Effective in the year 2005, the City of Lester Prairie will endorse the McLeod County Appliance Recycling policy and all matters of appliance recycling will be handled by McLeod County.

Motion - Angvall; Second - Bruckschen; Carried - Unanimously; For the second quarter billing in 2004, the City will waive the sewer charge for property located at 35 Fir Street North due to an undetected water leak since the water did not go into the sewer system, however, they will be billed for the full water charge.

Motion - Foust; Second - Anderson; Carried - Unanimously; To allow the removal of a boulevard tree by the home-owner at 231 Maple Street with the understanding that the full cost will be born by the homeowner, and should tree replacement be desired, it will be at the homeowner’s expense.

Motion - Hoof; Second - Anderson; Carried - Unanimously; To notify McLeod County Planning & Zoning that the City has no objections to the 2-lot subdivision as requested by Eugene Feltmann in Section 14 of Bergen Township to be known as Prairie Land Second Addition.

Motion - Angvall; Second - Bruckschen; Carried - Unanimously; To notify McLeod County Planning & Zoning that the City would have no objection to the conditional use permit as requested by Lois Ernst in Section 3 of Bergen Township if her business will be contained within the home, however, they do not feel it can be considered a home occupation if the business is located in an out building as proposed.

Councilmember Bruckschen introduced the following ordinance and moved for its adoption: ORDINANCE NO. 239 AN ORDINANCE PROHIBITING EXCESSIVE VEHICLE NOISE, INCLUDING NOISE FROM TRUCKS USING ENGINE RETARDING BRAKES, AND ADOPTING BY REFERENCE MINNESOTA STATUTES SECTIONS 169.69 AND 169.693 AND MINNESOTA RULES PARTS 7030.1000 TO 7030.1050. AND AMENDING CHAPTER 7 OF THE MUNICIPAL CODE ACCORDINGLY.

Mayor Angvall declared Ordinance No. 239 adopted by a unanimous vote this 10th day of May, 2004.

Motion - Hoof; Second - Bruckschen; Carried - Unanimously; To pay the claims as submitted.

Mayor Angvall adjourned the meeting at 9:00 p.m..
