Lester Prairie City Council Minutes

February 7, 2005

The Lester Prairie City Council met in regular session on Monday, February 7, 2005. Mayor Angvall called the meeting to order at 7:00 p.m..

Motion - Foust; Second - Hoof; Carried - Unanimously; To accept and approve the January Minutes as submitted.

Motion - Hoof; Second - Mallak; Carried - Unanimously; To accept and approve the January Treasurer’s Report as submitted.

Mayor Angvall introduced the following resolution and moved for its adoption: RESOLUTION NO. 7-05 RESOLUTION ACCEPTING SWIMMING POOL DONATION The foregoing motion was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 7-05 adopted by a unanimous vote this 7th day of February, 2005.

Mayor Angvall introduced the following resolution and moved for its adoption: RESOLUTION NO. 8-05 A RESOLUTION ORDERING SWIMMING POOL IMPROVEMENT, ACCEPTANCE OF PLANS, AND ADVERTISEMENT FOR BIDS The foregoing motion was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 7-05 adopted by a unanimous vote this 7th day of February, 2005.

Motion - Angvall; Second - Foust; Carried - Unanimously; To accept and approve the 2004 Audit as prepared and presented by Virchow Krause & Company and to further direct the City Clerk to publish the portions of the audit report as required.

General consensus of the City Council was to meet in special session during March to hold a workshop regarding the Wastewater Treatment Facility expansion project. At that time, it is anticipated proposal and cost estimate information should be available.

Consideration to amend the residency requirements for Liquor Licenses was tabled until the August meeting.

Councilmember Foust introduced the following ordinance and moved for its adoption: ORDINANCE NO. 245 AN ORDINANCE AMENDING CHAPTER 4, SECTION 4.2, SNOWMOBILE, ALL TERRAIN VEHICLE AND OFF-HIGHWAY MOTORCYCLE REGULATIONS AND AMENDING THE MUNICIPAL CODE ACCORDINGLY The forgoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Ordinance No. 245 adopted by a unanimous vote this 7th day of February, 2005.

Motion - Angvall; Second - Hoof; Carried - Unanimously; To give Officer Conzet a $ .35/hr. pay increase effective immediately.

Motion - Angvall; Second - Foust; Carried - Unanimously; To remove Officer Conzet from probationary status effective immediately.

Councilmember Hoof introduced the following resolution and moved for its adoption: RESOLUTION 5-05 A RESOLUTION ADOPTING THE NATIONAL INCIDENT MANAGEMENT SYSTEM The foregoing motion was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution 5-05 adopted by a unanimous vote this 7th day of February, 2005.

Councilmember Hoof introduced the following ordinance and moved for its adoption: ORDINANCE NO. 246 AN ORDINANCE AMENDING THE SEWER RATES IN THE CITY OF LESTER PRAIRIE AND AMENDING THE MUNICIPAL CODE ACCORDINGLY The foregoing motion was duly seconded by Councilmember Foust and following discussion thereon, a vote was taken. Mayor Angvall declared Ordinance No. 246 adopted by a unanimous vote this 7th day of February, 2005.

Motion - Hoof; Second - Foust; Carried - Unanimously; The City will not cover members of separate administrative boards or volunteers and will remain with the regular premium option for worker’s compensation coverage.

Mayor Angvall introduced the following resolution and moved for its adoption: RESOLUTION NO. 6-05 A RESOLUTION AUTHORIZING WORKER’S COMPENSATION COVERAGE TO CITY COUNCIL MEMBERS The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon a vote was taken. Mayor Angvall declared Resolution No. 6-05 adopted by a unanimous vote this 7th day of February, 2005.

Motion - Hoof; Second - Mallak; Carried - Unanimously; To inform McLeod County Planning & Zoning that the City has no objections to the conditional use permit as requested by Herbert Hoen to construct a 36’ x 64’ storage shed on his property in Section 1 of Bergen Township.

Councilmember Hoof introduced the following ordinance and moved for its adoption: ORDINANCE NO. 247 AN ORDINANCE TO AMEND SECTION 5.4 OF THE LESTER PRAIRIE MUNICIPAL CODE PERTAINING TO THE BUILDING CODE AND PROVIDING FOR PRE-CONSTRUCTION SITE INSPECTIONS The foregoing motion was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Angvall declared Ordinance No. 247 adopted by a unanimous vote this 7th day of February, 2005.

Mayor Angvall introduced the following resolution and moved for its adoption: RESOLUTION NO. 9-05 A RESOLUTION AMENDING THE BUILDING CODE FEE SCHEDULE The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 9-05 adopted by a unanimous vote this 7th day of February, 2005.

General consensus of the City Council was they would be interested in discussing the issue with Midwest Real Estate Services and Midwest Wireless Communications regarding a communications tower however, not necessarily in the area of the City’s park.

General consensus of the City Council was to meet in special session on Thursday, April 28, 2005, at 6:30 p.m. for the purpose of meeting as Local Board of Review.

Further discussion was tabled until the March meeting recycling within the City in order for Council members to give the issue greater consideration.

Mayor Angvall adjourned the meeting at 9:10 p.m.
