Lester Prairie City Council Minutes November 13, 2006

The Lester Prairie City Council met in regular session on Monday, November 13, 2006. Mayor Angvall called the meeting to order at 7:00 p.m.

Motion - Foust; Second - Bruckschen; Carried - Unanimously; To accept and approve the October Minutes as submitted.

Motion - Hoof, Second - Mallak; Carried - Unanimously; To accept and approve the October Treasurer’s Report as submitted.

General consensus of the City Council was that the City should prepare and provide handouts for the repair/replacement of curbs, gutters and driveway approaches.

General consensus of the City Council was to have Clerk Pawelk contact the Hutchinson Leader, as well as provide a copy of the photos, informing them of the poor delivery issue.

Councilmember Mallak introduced the following resolution and moved for its adoption: RESOLUTION NO. 37-06 A RESOLUTION AUTHORIZING THE PREPARATION OF PLANS FOR A SAFE ROUTE TO SCHOOLS GRANT APPLICATION AND CONTRACTING WITH BOLTON & MENK, INC. FOR ENGINEERING AND GRANT APPLICATION ASSISTANCE The foregoing resolution was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution 37-06 adopted by a unanimous vote this 13th day of November, 2006.

Councilmember Hoof introduced the following resolution and moved for its adoption: RESOLUTION NO. 40-06 A RESOLUTION APPROVING A CHANGE ORDER FOR THE WASTEWATER TREATMENT FACILITY CONSTRUCTION PROJECT AND REDUCING THE TOTAL PROJECT COST ACCORDINGLY The foregoing motion was duly seconded by Councilmember Bruckschen and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 40-06 adopted by a unanimous vote this 13th day of November, 2006.

Councilmember Hoof introduced the following ordinance and moved for its adoption: ORDINANCE NO. 263 AN ORDINANCE AMENDING LESTER PRAIRIE MUNICIPAL CODE TO AMEND SECTION 5.7.1.2, THE SCOPE OF THE RENTAL HOUSING ORDINANCE, AND TO ADD LANGUAGE CONCERNING THE LICENSING PERIOD DEADLINE, RENTAL INSPECTION FEES, QUALIFICATIONS OF RENTAL HOUSING INSPECTORS, REINSPECTION FEES, FINES AND ASSESSMENTS, DEFINITION OF SUBSTANDARD PROPERTY CONDITION, SUBSTANDARD PROPERTY CITATION AND DEFINITION OF EXCESSIVE CLUTTER. The foregoing motion was duly seconded by Councilmember Foust and following discussion thereon, a vote was taken. Mayor Angvall declared Ordinance No. 263 adopted by a unanimous vote this 13th day of November, 2006.

Councilmember Foust introduced the following resolution and moved for its adoption: RESOLUTION NO. 38-06 A RESOLUTION AUTHORIZING A JOINT POWERS AGREEMENT BETWEEN THE CITY OF LESTER PRAIRIE (“CITY”) AND BERGEN TOWNSHIP (“TOWNSHIP”) REGARDING THE MAINTENANCE OF A PORTION OF 175TH STREET The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon a vote was taken. Mayor Angvall declared Resolution No. 38-06 adopted by a unanimous vote this 13th day of November, 2006.

Motion - Mallak; Second - Bruckschen; Carried - Unanimously; To enter into a three year agreement with MacNeil Environmental Inc. to provide Health & Safety management, for city staff, to include on-site administration, program updating and review, 24 hour account manager availability, on-site employee training and surveillance and documentation activities at the fees of $1,967.00 for year one, $2,026.00 for year two and $2,087.00 for year three.

Motion - Foust; Second - Bruckschen; Carried - Unanimously; To direct City Attorney Jody Winters to contact rental dwelling owner Diane Olson that the window replacement at her rental dwelling must be complete by December 31, 2006, as compliance for rental dwelling inspections was March 31, 2006, and she has had ample time to have the work completed.

Councilmember Foust introduced the following resolution and moved for its adoption: RESOLUTION NO. 39-06 A RESOLUTION AUTHORIZING THE PURCHASE OF A 2007 POLICE INCEPTOR VEHICLE

The foregoing motion was duly seconded by Councilmember Bruckschen and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 39-06 adopted by a unanimous vote this 13th day of November, 2006.

Councilmember Mallak introduced the following resolution and moved for its adoption: RESOLUTION NO. 41-06 A RESOLUTION FOR MCLEOD COUNTY ASSESSOR SERVICES The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 41-06 adopted by a unanimous vote this 13th day of November, 2006.

Motion - Mallak; Second - Bruckschen; Carried - Unanimously; Councilmember Mallak is hereby directed and authorized to purchase up to 14 holiday banners at the approximate cost of $65.00 each.

At 8:00 p.m. Mayor Angvall opened the public hearing for the proposed special assessments of unpaid utility and mowing bills to the City.

Mayor Angvall closed the public hearing at 8:15 p.m..

Councilmember Bruckschen introduced the following resolution and moved for its adoption: RESOLUTION NO. 42-06 A RESOLUTION ADOPTING ASSESSMENT FOR UNPAID BILLS The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 42-06 adopted by a unanimous vote this 13th day of November, 2006.

Motion - Angvall; Second - Bruckschen; Carried - Unanimously; Police Chief Carlson is authorized and directed to obtain information and quotes for seamless gutters to be installed on the police office.

Mayor Angvall introduced the following resolution and moved for its adoption: RESOLUTION NO. 43-06 A RESOLUTION AUTHORIZING THE SALE OF FORFEITED PROPERTY The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 4306 adopted by a unanimous vote this 13th day of November, 2006.

Motion - Hoof, Second - Mallak; Carried - Unanimously; To pay the claims as submitted.

Mayor Angvall adjourned the meeting at 8:20 p.m..
