City of Lester Prairie

May 7th, 2007

The Lester Prairie City Council met in regular session on Monday, May 7th, 2007.

Mayor Angvall called the meeting to order at 7:00 p.m.

Motion - Foust; Second - Mallak; Carried - Unanimously; To accept and approve the April Minutes as submitted.

Motion - Mallak; Second - Foust; Carried - Unanimously; To accept and approve the April Treasurer’s Report as submitted.

Motion - Hoof, Second - Heimerl; Carried - Unanimously; To authorize the Mayor and/or City Clerk to contest the OSHA findings and citations once the information arrives.

Motion - Hoof, Second - Foust; Carried - Unanimously; To have the Compliance Order posted on the door for the rental property owned by Diane Olson and have the City’s Attorney send Mrs. Olson a letter informing her of the action. Further, if she doesn’t respond to the Compliance Order, the City’s Attorney is directed to file the Summons and Compliance Order with the court.

General consensus of the City Council was to have the electrical work completed as necessary and approve the change order at the June meeting. The City will purchase and replace the rotor blades for the existing oxidation ditch rather than having the contractor do the work.

Councilmember Mallak introduced the following resolution and moved for its adoption: RESOLUTION NO. 16-07 A RESOLUTION AUTHORIZING THE ACCEPTANCE OF PHOSPHORUS REDUCTION GRANT FROM THE STATE OF MINNESOTA The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 16-07 adopted by a unanimous vote this 7th day of May, 2007.

General consensus of the City Council was for Clerk Pawelk to send Mr. Juncewski a letter asking that the development sign be removed by the first of June.

Motion - Heimerl; Second - Mallak; Carried - To approve the remodeling of the press box owned by School District #424 located in the park. There will be no cost to the City, a building permit will have to be obtained and the structure will have to comply with the state building code.

Councilmember Mallak introduced the following resolution and moved for its adoption: RESOLUTION NO. 18-07 A RESOLUTION AUTHORIZING THE SUBMISSION OF A DEPARTMENT OF HOMELAND SECURITY GRANT APPLICATION The foregoing resolution was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 18-07 adopted by a majority vote this 7th day of May, 2007.

Motion - Hoof, Second - Foust; Carried; To have Clerk Pawelk contact the engineering firm of Bolton & Menk to look at the condition of the alley between Maple Street North and Juniper Street North and prepare a feasibility report. Voting for the motion: Hoof, Foust, Angvall and Heimerl Voting against the motion: None Abstained from vote: Mallak

Motion - Hoof, Second - Mallak; Carried - Unanimously; To not grant the sidewalk encroachment per the drawing of April 9th, 2007, for the property at 518 Central Avenue however, require the drawing and request be modified for a handicap access to the building.

Councilmember Foust introduced the following resolution and moved for its adoption: RESOLUTION 17-07 A RESOLUTION DECLARING A PART-TIME POLICE OFFICER FOR PUBLIC EMPLOYEES RETIREMENT ASSOCIATION MEMBERSHIP The foregoing resolution was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 17-07 adopted by a unanimous vote this 7th day of May, 2007.

Councilmember Heimerl introduced the following resolution and moved for its adoption: RESOLUTION NO. 19-07 A RESOLUTION ACCEPTING RESIGNATION OF PART-TIME OFFICER The foregoing motion was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Angvall declared Resolution No. 19-07 adopted by a unanimous vote this 7th day of May, 2007.

Motion - Hoof, Second - Mallak; Carried - Unanimously; To issue a special use permit to Michelle Roepke for a home occupation of massage therapy.

Motion - Hoof, Second - Foust; Carried - Unanimously; To authorize the purchase of a Saber 17 inch automatic scrubber from Hillyard Floor Products in Hutchinson at the cost of $3,695.00.

Motion - Heimerl; Second - Foust; Carried - Unanimously; To hire the following summer staff.Corey Dammann at $8.50/hr. for lawn mowing; Basket/Concession Workers - Mackenzie Alberts, Paige Aldrich, Brianna Briggs, Derek Litzau, Matthew Madsen, Kari Rathkamp, Michael Schnaser and Heather Stutleberg at $ 6.15 per hour plus a $ .25/hr/yr. increase for returning staff, Lifeguards - Amy Birkholz, Morgan Bandemer, Alyssa Guenningsman, Zach Hubert, Heidi Jurek, Megan Jurek, Erin Klobe, Sara Micholichek, Mollie Piehl, Angie Rathkamp, Ben Schwanke, Ingrid Tanner and Kayle Weinmann at $8.25/hr. plus $.25/hr/yr. for returning staff. The City will purchase lifeguard suits and red t-shirts for basket/concession stand staff.

Motion - Heimerl; Second - Mallak; Carried - Unanimously; To purchase signs for the concession stand and to increase pass rates by $5.00 and individual rates by $1.00.

General consensus of the City Council was that flowers could be put on the base but not on flat stones or on the grass. Sheppard hooks would only be allowed if they were in the base or stone but not on the grass.

Motion - Foust; Second - Hoof-, Carried - Unanimously; To obtain information for placement of a sign at the cemetery regarding the regulations.

Motion - Foust; Second - Heimerl; Carried - Unanimously; To pay the claims as submitted.

Mayor Angvall adjourned the meeting at 10:10 p.m.
