February 9, 2009
The Lester Prairie City Council met in regular session on Monday, February 9th, 2009. Mayor Heimerl called the meeting to order at 6:00 p.m.
At 6:00 p.m., Mayor Heimerl announced that he was closing the public meeting as a continuance of the January 12, 2009, closed meeting regarding employee performance review.
Motion - Hoof; Second - Mallak; Carried - Unanimously; To adjourn the closed meeting.
At 6:41 p.m., Mayor Heimerl reconvened the public portion of meeting.
Motion - Foust; Second - Messer; Carried - Unanimously; To accept and approve the January Minutes as submitted.
Motion - Mallak; Second - Hoof; Carried - Unanimously; To accept and approve the January Treasurer’s Report as submitted.
Motion - Heimerl; Second - Messer; Carried - To set the Lester Prairie City Council meeting for the second Tuesday of every month at 7:00 p.m. beginning with the March meeting.
General consensus of the City Council was to have Clerk Pawelk advertise for the Park Board and Planning & Zoning Commission vacancies.
Councilmember Hoof introduced the following ordinance and moved for its adoption: ORDINANCE NO. 283 AN ORDINANCE AMENDING CHAPTER 2, SPECIFICALLY SECTION 2.4, WATERWORKS, IN THE CITY OF LESTER PRAIRIE AND AMENDING THE MUNICIPAL CODE ACCORDINGLY The foregoing motion was duly seconded by Councilmember Mallak and following discussion thereon, a vote was taken. Mayor Heimerl declared Ordinance No. 283 adopted by a unanimous vote this 9th day of February, 2009.
Councilmember Mallak introduced the following resolution and moved for its adoption: RESOLUTION NO. 3-09 A RESOLUTION ACCEPTING RESIGNATION OF PART-TIME OFFICER The foregoing resolution was duly seconded by Councilmember Messer and following discussion thereon, a vote was taken. Mayor Heimerl declared Resolution No. 3-09 adopted by a unanimous vote this 9th day of February, 2009.
General consensus of the City Council was for the Police Chief to post an opening for a part-time police officer position.
Information was received from the McLeod County Assessor’s Office that the Local Board of Review for Lester Prairie has been scheduled for Monday, April 20th at 6:30 p.m.
Councilmembers Foust and Messer stated they would make arrangements to attend one of the training sessions for Local Board of Appeal and Equalization certification.
Motion - Foust; Second - Mallak; Carried - Unanimously; To accept and approve the 2008 Audit as prepared by Virchow Krause & Company.
Motion - Mallak; Second - Hoof; Carried - Unanimously; To authorize Clerk Pawelk to published the portions of the audit as required.
At 7:42 p.m., Mayor Heimerl recessed the meeting. He reconvened the meeting at 7:44 p.m.
Councilmember Hoof introduced the following resolution and moved for its adoption: RESOLUTION NO. 4-09 A RESOLUTION GRANTING A VARIANCE TO MILAN AND BARBARA DAMMANN WITH CONDITIONS The foregoing motion was duly seconded by Councilmember Messer and following discussion thereon, a vote was taken. Mayor Heimerl declared Resolution No. 4-09 adopted by a majority vote this 9th day of February, 2009.
General consensus of the City Council was that they could not require soil or compaction testing be done prior to construction of the Dammann accessory building since it is not part of the code requirement. This would be the owner’s responsibility to ensure the suitability of the subsoil prior to construction.
Motion - Mallak; Second - Foust; Carried - Unanimously; To pay the claims as submitted.
Mayor Heimerl adjourned the meeting at 8:03 p.m.
