November 9, 2010
Pursuant to posted public notice, the Lester Prairie City Council met in regular session on Tuesday, November 9, 2010. Mayor Heimerl called the meeting to order at 6:30 p.m.
The purpose of the change in time was to canvass the November 2, 2010, election results and conduct a special assessments public hearing.
An election report was provided to the City Council. A total of 634 votes were cast at the November 2, 2010 election.
Motion – Heimerl; Second – Foust; Carried – Unanimously; To accept and certify as correct the judges’ report of the 634 votes cast and declare the results of the City Election held on November 2, 2010.
At 6:45 p.m., Mayor Heimerl opened the Special Assessments Public Hearing. Clerk Pawelk provided information regarding the public notice, the notices sent to the affected property owners, as well as, a listing of the assessments. At the time of the mailings, the assessments for unpaid bills totaled $6,491.03. She noted four of the properties have since paid their past due balances for utility bills.
Correspondence items received were reviewed and there was not anyone in attendance for the public hearing.
Mayor Heimerl closed the public hearing at 6:55 p.m.
Councilmember Hoof introduced the following resolution and moved for its adoption: RESOLUTION NO. 25-10 A RESOLUTION ADOPTING ASSESSMENT FOR UNPAID BILLS The foregoing motion was duly seconded by Councilmember Foust and following discussion thereon, a vote was taken. Mayor Heimerl declared Resolution No. 25-10 adopted by a unanimous vote this 9th day of November, 2010.
Motion – Foust; Second – Mallak; Carried – Unanimously; To accept and approve the October Minutes as submitted.
Motion – Messer; Second – Hoof; Carried – Unanimously; To accept and approve the October Treasurer’s Report as submitted.
Motion – Messer; Second – Mallak; Carried – Unanimously; To utilize the service of Kahnke Brothers Inc. for the downtown park irrigation system, for start up in spring and winterizing.
Motion- Mallak; Second – Hoof; Carried – Unanimously; To advertise the 1992 Chevrolet pickup for sale with a minimum starting bid of $2,500.00 and bids are to be submitted to city hall on or before December 10th.
Motion – Hoof; Second – Messer; Carried – Unanimously; To authorize the purchase of a Kubota RTV with cab and cargo box spreader at the cost of $22,122.00, including tax.
Motion – Foust; Second – Hoof; Carried – Unanimously; To enter into an agreement with the McLeod County Assessor’s Office for assessing services in 2011 at the cost of $8,369.00.
Motion – Mallak; Second – Messer; Carried – Unanimously; To authorize the Mayor and/or City Clerk to enter into an agreement with the McLeod County Highway Department for use of the snow blower under the terms as discussed at this meeting.
Motion – Mallak; Second – Hoof; Carried – Unanimously; To award the 2010-2011 snow removal agreement to Litzau Excavating Inc. at the rates quoted.
Councilmember Foust introduced the following ordinance and moved for its adoption: ORDINANCE NO. 289 AN ORDINANCE AMENDING 3.3 OF THE LESTER PRAIRIE CODE, SPECIFICALLY SECTION 3.3.1 REGARDING SIDEWALK MAINTENANCE, REPAIR, SNOW AND ICE REMOVAL AND STORAGE OF MERCHANDISE The foregoing motion was duly seconded by Councilmember Hoof and following discussion thereon, a vote was taken. Mayor Heimerl declared Ordinance No. 289 adopted by a unanimous vote this 9th day of November, 2010.
General consensus of the City Council was that the location of the Water Treatment Facility shall be on the East side of the current well building and that the generator will not be moved since the City just spent a considerable amount of money putting the generator in the well building.
General consensus of the City Council was to authorize the surveying for the storm sewer work and determine at a later date if the work will be included at this time or not.
Councilmember Hoof introduced the following ordinance and moved for its adoption: ORDINANCE NO. 290 AN ORDINANCE AMENDING CHAPTER 5, SPECIFICALLY SECTIONS 5.1.2.13 AND 5.1.4.4 LAND USE, IN THE CITY OF LESTER PRAIRIE AND AMENDING THE MUNICIPAL CODE ACCORDINGLY The foregoing motion was duly seconded by Councilmember Messer and following discussion thereon, a vote was taken. Mayor Heimerl declared Ordinance No. 290 adopted by a unanimous vote this 9th day of November, 2010.
General consensus of the City Council was to advertise for a part-time person to help with snow removal at the starting rate of $12.00 per hour.
Motion – Mallak; Second – Hoof; Carried – Unanimously; To pay the claims as submitted.
Mayor Heimerl adjourned the meeting at 8:20 p.m.
