City of Lester Prairie Ordinance 227 - Liquor licensing
ORDINANCE NO. 227
AN ORDINANCE ESTABLISHING CERTAIN CIVIL PENALTIES FOR LICENSE VIOLATION, REQUIRING COMPLIANCE CHECKS FOR ALL NON-INTOXICATING LIQUOR AND INTOXICATING LIQUOR LICENSE HOLDERS, AND AMENDING PORTIONS OF CHAPTER 6.2 OF THE LESTER PRAIRIE MUNICIPAL CODE
The City Council of the City of Lester Prairie ordains:
Section 1. The following Section 6.1.9 was added to the Lester Prairie Municipal Code:
Section 6.1.9 License Discipline Civil Penalties. The City Council shall be entitled to impose the following civil penalties for license violations of any license issued pursuant to Chapter 6 of the Lester Prairie Municipal Code:
(a) The first violation: a fine of $500.00.
(b) The second violation within 24 months of the first violation: a fine of $750.00.
(c) A third violation within 36 months of the first violation: a fine of $750.00 and a three-day license suspension. If no hearing is requested by the license holder, the following three business days from notification will be the days of suspension. If a hearing is requested by the license holder, the days of suspension will be determined by the City Council.
(d) A fourth violation within 48 months of the first violation: license revocation.
Notwithstanding the foregoing civil penalties, the City Council shall retain the right to suspend or revoke licenses in severe cases of violation, the foregoing civil fines being a general guideline.
Section 2. The following Section 126.96.36.199 was added to the Lester Prairie Municipal Code:
188.8.131.52 Law Enforcement Officials and/or such other public official as the City directs, shall conduct compliance checks on each licensed establishment at least twice per each calendar year and in the case of any establishment who is determined to have violated this code, a follow-up compliance check will be done within four months of the final determination of violation, whether or not the licensee passes the inspection or check.
Section 3. This ordinance shall be in force and effect from and after its passage and publication.
