SUMMARY OF ORDINANCE NO. 264
AN ORDINANCE AMENDING THE LESTER PRAIRIE MUNICIPAL CODE TO PROVIDE FOR SEDIMENT AND EROSION CONTROL
BY ESTABLISHMENT OF
CHAPTER 5.9 OF THE
LESTER PRAIRIE MUNICIPAL CODE
The City Council of the City of Lester Prairie ordains:
Section 1: This ordinance is adopted for the purpose of 1) regulating the movement of sediment and the installation/maintenance of approved Best Management Practices (BMP’s) as well as, 2) regulating uncontained debris, at building and construction sites within the jurisdiction of the City of Lester Prairie. The objective of the City in adopting this ordinance is to provide for a uniform method of regulating the runoff of soil, dirt or other organic or inorganic material into Waters of the State as well as regulating wind borne or otherwise uncontrolled construction debris.
Section 2: These standards are derived from and in agreement with National Pollutant Discharge Elimination System (NPDES) standards and other local Water Resource Management Rules. The provisions of this ordinance shall be in effect from the first land disturbance to the establishment of permanent yard or ground.
Section 3: The following Chapter 5.9 is added to the Lester Prairie Municipal Code:
5.9.1 DEFINITIONS: This section contains the definition for 15 separate terms used within the ordinance.
5.9.2 PENALTIES: This section sets forth the penalties which may be imposed for violation of the ordinance, including punishment as a misdemeanor under Minnesota law, civil fines and stop work orders.
5.9.3 ENFORCEMENT: This section establishes the City Building Inspector of the City of Lester Prairie as the enforcement officer.
5.9.4 SEDIMENT CONTROL MEASURES: This section provides for the use of silt fences and sets forth specifications for their use; and also sets forth alternate methods when silt fences are not practical.
5.9.5 EROSION CONTROL MEASURES: This section provides for erosion control by use of vegetation (seed/sod), mulch, hay/straw bales and mats in particular circumstances.
5.9.6 TEMPORARY CONSTRUCTION DRIVEWAYS: This section provides for the design and maintenance of temporary driveways until a permanent driveway is constructed.
5.9.7 GENERAL SITE MAINTENANCE: This section provides for debris containment, debris removal, debris storage, and weed/underbrush containment.
5.9.8 APPEALS: This section provides for appeals from Building Inspector’s decisions, first by request for reconsideration, then to the city council; and also specifying appeals to be made within 10 days of the decision, or reconsideration; and also providing that all appeals must be in writing.
Section 4: This Ordinance shall be in full force and effect from and after the date of its passage and publication according to law. The City Clerk is authorized to publish the ordinance in summary form and to maintain copies on file for public inspection.
