SUMMARY OF ORDINANCE NO. 273

AN ORDINANCE REPEALING SECTION 2.6, OF THE LESTER PRAIRIE MUNICIPAL CODE PERTAINING TO SANITARY SEWER SYSTEM ORDINANCE PROVIDING FOR DEFINITIONS, USE OF PUBLIC SEWERS, PROHIBITIONS, PERMANENT APPLICATIONS AND

PENALTIES FOR VIOLATIONS OF THE PROVISIONS CONTAINED

HEREIN

THE CITY OF LESTER PRAIRIE ORDAINS:

Ordinance No. 273 repeals Section 6.2 of the Lester Prairie Municipal Code and replaces it with a revised sanitary sewer systems ordinance providing for definitions, use of public sewers, prohibitions, permanent applications and penalties for violations of the provisions contained herein. Said ordinance is divided into ten (10) main sections, which are summarized herein.

Section 1. This section consists of definitions.

Section 2. This section relates to the City’s responsibility for the sewer main line, the landowner’s responsibility for the sewer service line and describes prohibited acts.

Section 3. This section relates to private waste water disposal.

Section 4. This section relates to building sewers and connections.

Section 5. This section relates to the use of public sewer and prohibits persons from discharging or causing to be discharged unpolluted waters, prohibited liquids and substances and remedies for the City if unpolluted waters, liquids and substances are discharged into the sanitary sewer system.

Section 6. This section relates to the requirements for discharges into the City’s waste water disposal system and enables the City to comply with state and federal laws. This section’s objective is to prevent the introduction of pollutants into the waste water disposal system which will interfere with the operation of the sewer system or the use or disposal of the sludge to prevent introduction of pollutants into the waste water disposal system which will pass through the system and inadequately treated into receiving waters or the atmosphere or otherwise be incompatible with the system and improve the opportunity to recycle and reclaim waste water and sludge from the system. This section also provides for the regulation of discharges into the City’s waste water disposal systems through the issuance of permits and fees to certain users and through enforcement of the general requirements for other users, authorizes monitoring, enforcement activities and hearing requirements, requires user reporting and provides for establishing fees for the equitable distribution of cost resulting from the program established herein. This section also defines the applicability of the ordinance to persons and the City.

Section 7. This section prohibits persons from willfully or negligently damaging the sanitary sewer system.

Section 8. This section relates to the powers and authority of waste water

inspectors.

Section 9. This section provides for criminal penalties for violating the ordinance.

Section 10. This section relates to monthly sewer service charges/fees.

The foregoing is a summary of Ordinance No. 273 which consists of a 30-page document, a full text of which is on copy with the City Clerk and is available for review and inspection by the public during business hours.

This ordinance was adopted by the City of Lester Prairie on the 13th day of August, 2007.
