ORDINANCE NO. 290
AN ORDINANCE AMENDING CHAPTER 5, SPECIFICALLY SECTIONS 5.1.2.13 AND 5.1.4.4 LAND USE, IN THE CITY OF LESTER PRAIRIE AND AMENDING THE MUNICIPAL CODE ACCORDINGLY
THE CITY COUNCIL OF THE CITY OF LESTER PRAIRIE ORDAINS:
Section 1. Section 5.1.2.1(b) Permits Required Exempted Work, shall be deleted in its entirety and the following Section 5.1.2.1(b) shall be inserted in its place:
“(b) Fences up to 6 (six) feet in height, when measured from the ground to the highest point, are to have a minimum 2 (two) foot setback from the property do not require a permit. Fences over 6 (six) feet in height, when measured from the ground to the highest point, require a minimum setback of 2 (2) feet from the property line and a building permit. All fences will require a minimum of 4 (four) foot setback from property lines abutting any street or alley. This section does not apply to B-1 CENTRAL BUSINESS DISTRICTS.”
Section 2. Section 5.1.2.13 Fences and Other Vision Obstructing Objects, shall be deleted and the following Section 5.1.2.13 shall be inserted in its place:
“5.1.2.13 Fences and Other Vision Obstructing Objects. No objects including but not limited to, fences, walls, structures, trees, shrubs, vegetation, vehicles, machinery or equipment shall be located, erected, established or maintained on a corner lot, where the curb lines meet at a street intersection, for a distance of twenty-five (25) feet from the intersecting curb line, which exceeds thirty-two (32) inches in height as measured from the grade elevation of the property abutting the curb line. This Section does not apply to B-1 District.”
Section 3. Section 5.1.4.4, Corner Lot, Special Assessments shall be deleted and the following Section 5.1.4.4 shall be inserted in its place:
“5.1.4.4 Corner Lot, Special Assessments. On any corner lot or lot fronting on more than one street, no objects including but not limited to fences, walls, structures, trees, shrubs, vegetation, vehicles, machinery or equipment shall be erected, established or maintained on a corner lot where the curb lines meet at a street intersection for a distance of twenty (25) feet to any curb line abutting and paralleling a street. All corner lots shall be at least ten (10) percent larger in lot frontage at the building line and lot area than is required below for one and two family dwellings.”
Section 4. This Ordinance shall take effect and be in force from and after its passage and publication.
