1. CALL TO ORDER
Mayor McDonald called the regular meeting of the Delano City Council/Economic Development Authority of Tuesday, April 21, 2009 to order at 7:02 PM.

2. ROLL CALL AND APPROVAL OF AGENDA
Members Present: Joe McDonald, Mayor; Holly Schrupp, Council Member; Brad Hotchkiss, Council Member; Larry Bartels, Council Member; Betsy Stolfa, Council Member.
Members Absent: None.
Also Present: Phil Kern, City Administrator; Mark Johnson, City Attorney; Vince Vander Top, City Engineer; Alan Brixius, City Planner; Chuck Keyes, WWTP; Ernie Eden, Public Works Director; Marlene Kittock, City Clerk/AV Director; Paula Bauman, Recorder.
Motion Number (M-09-118) Motion by Holly Schrupp, seconded by Betsy Stolfa to approve the agenda of the regular City Council/Economic Development Authority meeting of Tuesday, April 21, 2009 with the addition of 6A: Approve Letter of Credit for Parkview Hills. Motion Carried.
3. MINUTES
A. Minutes of the Special Workshop of Tuesday, March 31, 2009.
Motion Number (M-09-119) Motion by Brad Hotchkiss, seconded by Larry Bartels to approve the minutes of the Special Workshop of Tuesday, March 31, 2009 as submitted. Motion Carried 4-0-1 with Joe McDonald abstaining.
B. Summary minutes of the Special Workshop of Tuesday, March 31, 2009 for publication in the Delano Herald Journal.
Motion Number (M-09-120) Motion by Larry Bartels, seconded by Betsy Stolfa to approve the summary minutes of the Special Workshop of Tuesday, March 31, 2009 for publication in the Delano Herald Journal as submitted. Motion Carried 4-0-1 with Joe McDonald abstaining.
C. Minutes of the regular City Council/Economic Development Authority of Tuesday, April 7, 2009.
Motion Number (M-09-121) Motion by Betsy Stolfa, seconded by Brad Hotchkiss to approve the minutes of the regular City Council/Economic Development Authority of Tuesday, April 7, 2009 as submitted. Motion Carried 3-0-2 with Joe McDonald and Holly Schrupp abstaining.
4. SPEAKERS, PRESENTATIONS AND AWARDS
PROCLAMATION: St. Paul’s United Church of Christ is celebrating 130 years of welcoming and progressive faith based ministry to the Delano Community.
5. CONSENT ITEMS
City:
A. Motion to approve the purchase of a new power washer for the Public Works Department.
B. Staff recommends approval of the Community Garden By-Laws and appointment of the Garden Committee.
C. Approve a public facility lease and licenses between the City of Delano and the Delano 4th of July Committee.
D. Approve the purchase of a server to provide data backup for the Delano Municipal Liquor Store.
E. Request approval of Change Order No. 4 and Pay Request No. 4 for 85th Street Improvements.
F. Approval to accept $400 donation from the Delano Knights of Columbus to co-sponsor the Blood Pressure Clinic held at the Delano Senior Center.
G. Approval to purchase three sections of carpeted stage to match the one section of state the Senior Center already owns.
H. Approve Adopt-a-Park/Trail assignments and authorize the volunteers to begin work.
I. Approve request from St. Peter’s Catholic Church and School for a street dance on May 30, 2009.
J. Adopt Resolution R-09-11 approving the Gambling Application Exempt Permit for Delano Catholic Community for the annual St. Peter’s School Raffle.
K. Consider the purchase of a new printer.
Motion Number (M-09-122) Motion by Larry Bartels, seconded by Holly Schrupp to approve the Consent Items A, C, D, E, G, H, J and K as submitted. Motion Carried 5-0 by Roll Call Vote.
5B. Staff recommends approval of the Community Garden By-Laws and appointment of the Garden Committee.
Motion Number (M-09-123) Motion by Betsy Stolfa, seconded by Brad Hotchkiss to approve the Community Garden By-Laws and appoint the Garden Committee. Motion Carried.
5F. Accept $400 donation from the Delano Knights of Columbus to co-sponsor the Blood Pressure Clinic held at the Delano Senior Center.
Motion Number (M-09-124) Motion by Joe McDonald, seconded by Holly Schrupp to accept the $400 donation from the Delano Knights of Columbus to co-sponsor the Blood Pressure Clinic held at the Delano Senior Center. Motion Carried.
5I. Approve request from St. Peter’s Catholic Church/School for a street dance on May 30, 2009.
Motion Number (M-09-125) Motion by Holly Schrupp, seconded by Larry Bartels to approve the request from St. Peter’s Catholic Church/School for a street dance on May 30, 2009. Motion Carried.
6. CITY STRATEGY No. 1: Provide high quality infrastructure and services in a planned fiscally responsible manner.
A. Approve Letter of Credit for Parkview Hills.
Motion Number (M-09-126) Motion by Betsy Stolfa, seconded by Larry Bartels to release a portion of Letter of Credit for Parkview Hills Third Addition contingent on all accounts received from the developer to the City being paid. Motion Carried.
B. Consider the request from Dale and Lynn Graunke for a setback variance to encroach upon the south side yard setback at 241-3rd Street South, Delano MN.
1. Adopt Resolution R-09-12 approving a side-yard setback variance to allow an attached garage to be located two feet from the south lot line at 241-3rd Street South, Delano MN.
Motion Number (M-09-127) Motion by Betsy Stolfa, seconded by Brad Hotchkiss to adopt Resolution R-09-12 approving a side-yard setback variance to allow an attached garage to be located two feet from the south lot line at 241-3rd Street South, Delano MN 55328. Motion Carried 5-0 by Roll Call Vote.
C. Consider request from Laurence Rieder and Joan Apman-Rieder, 600 Buffalo Street, requesting guidance regarding the construction of an accessory structure in excess of 1200 square feet.
D. Consider the response correspondence regarding the 2009 comprehensive amendment for the City of Independence.
Motion Number (M-09-128) Motion by Holly Schrupp, seconded by Larry Bartels to approve the response correspondence regarding the 2009 comprehensive amendment for the City of Independence with the addition of the phrase “inappropriate at this time”. Motion Carried 4-1 with Brad Hotchkiss opposed.
E. Consider 2009 Seal Coat project and authorizes staff to seek bids.
Motion Number (M-09-129) Motion by Brad Hotchkiss, seconded by Betsy Stolfa to authorize the 2009 Seal Coat Project and authorize Staff to seek bids. Motion Carried.
F. Consider improvements to Westridge Hills 3rd/4th Addition Park – Landscape Structures proposal.
Motion Number (M-09-130) Motion by Betsy Stolfa, seconded by Holly Schrupp to authorize the improvements to Westridge Hills 3rd/4th Addition Park with the Rocks and Ropes playground concept through Landscape Structures; with the future installation of swings. Motion Carried 4-0-1 with Brad Hotchkiss abstaining.
9. CITY STRATEGY No. 4: Ensure a well-trained and productive workforce to meet the changes of the City.
A. Discuss and approve the Citizen Emergency Response Team (CERT) procedural manual for the CERTS program.
Motion Number (M-09-131) Motion by Brad Hotchkiss, seconded by Betsy Stolfa to approve the Citizen Emergency Response Team (CERT) procedural manual for the CERTS program. Motion Carried.
12. CITY STRATEGY No. 7: Encourage communication and ideas with residents and business owners.

14. OTHER BUSINESS
A. Attorney/Client Privilege: Discuss litigation regarding the Northwest Interceptor Project.
Motion Number (M-09-132) Motion by Larry Bartels, seconded by Holly Schrupp to enter into Executive Session for purpose of discussing litigation regarding the Northwest Interceptor Project. Motion Carried.
Motion Number (M-09-133) Motion by Holly Schrupp, seconded by Betsy Stolfa to exit out of Executive Session. Motion Carried.
15. CLAIMS

Motion Number (M-09-134) Motion by Holly Schrupp, seconded by Larry Bartels to approve the City Claims in the amount of $240,133.27.
16. ADJOURNMENT
Motion Number (M-09-135) Motion by Holly Schrupp, seconded by Larry Bartels to adjourn the regular meeting of the Delano City Council/Economic Development Authority of Tuesday, April 21, 2009. Motion Carried.
