CITY OF DELANOWRIGHT COUNTY, MINNESOTAORDINANCE NO.: O-09-05 AN ORDINANCE AMENDING THE DELANO ZONING MAP OF THECITY OF DELANO, MINNESOTATHE CITY COUNCIL OF DELANO ORDAINS:
Section 1. The current Official Zoning Map of the City of Delano is hereby amended to change the zoning designation for land described below from R-4, Single and Two Family Residential District to R-E, Single Family Estate Residential District:

Section 2. The Zoning Administrator is hereby directed to make the appropriate changes to the Official Zoning Map of the City of Delano to reflect the change in zoning set forth above.
Section 3. This ordinance shall be effective immediately upon passage and publication.

MONTROSE PLANNING AND ZONING COMMISSION PUBLIC NOTICE APPLICATION FOR REZONING ANDCONDITIONAL USE PERMIT
NOTICE IS HEREBY GIVEN that on Wednesday, June 17, 2009 at the MONTROSE Planning and Zoning Commission meeting which begins at 7:00 p.m., a public hearing will be held at the MONTROSE Community Center to consider the Application for a rezone request and a conditional use permit as submitted by the applicant Bauer Design Group and owner Village Bank.
The application, if approved, would allow rezoning of parcel 112500363303 at 115 Second Street South from RB, Residential Business to INS, Institutional and a Conditional Use Permit to allow a commercial daycare at 115 Second Street South as part of a proposed Montrose Early Education Center.
All persons interested are invited to attend said hearing and be heard on this matter.

NOTICE IS HEREBY GIVEN that on Wednesday June 17, 2009 at the MONTROSE Planning and Zoning Commission meeting which begins at 7:00 p.m., a public hearing will be held at the MONTROSE Community Center to consider a text amendment to the Montrose Zoning Ordinance.
The application, if approved, would allow for a Text Amendment to the Montrose Zoning Ordinance Section 1082-4, to include Commercial Daycare Centers as a Conditional Use in the INS, Institutional District.

CERTIFICATE OF COMMENDATION: Awarded to the City of Delano its Wastewater Treatment Facility Staff from the Minnesota Pollution Control Agency Commissioner, Paul Eger.
5. CONSENT ITEMS
EDA:
A. Adopt Resolution EDA-09-04 approving the implementation of a Delano EDA/Crow River Villa Security and Apartment Key Policy dated May 5, 2009.
CITY:
B. Consider additional Adopt-A-Park applications.
C. Adopt Resolution approving a side yard setback variance to allow an attached garage to be located two feet from the south lot line at 241-3rd Street South, Delano Minnesota.
D. Approve the request of Virgil Scherping of Crow River Harley for a one-year extension to the Site and Building Plan Review and two Conditional Use Permits for an exception to the building elevation materials (metal building Ordinance) and outdoor sales and service for the property located at 822 Babcock Boulevard, Delano Minnesota.
E. Review the City of Delano Expenditure Report and the Liquor Store Income Statement for the Quarter Ending March 31, 2009.
F. Review quotes and approve an official depository for the City of Delano.
G. Approve hiring six seasonal workers for the City of Delano Public Works.
H. Motion approving the agreement with the Initiative Foundation and authorization to act as fiscal agent for the Delano Dream Team II.

Motion Number (M-09-142) Motion by Brad Hotchkiss, seconded by Betsy Stolfa to adopt Resolution EDA-09-04 approving the implementation of a Delano EDA/Crow River Villa Security and Apartment Key Policy dated May 5, 2009. Motion Carried 5-0 by Roll Call Vote.
5H. Motion approving an agreement with the Initiative Foundation and authorization to act as fiscal agent for the Delano Dream Team II.
Motion Number (M-043) Motion by Holly Schrupp, seconded by Brad Hotchkiss to approve the agreement with the Initiative Foundation and authorization to act as fiscal agent for the Delano Dream Team II. Motion Carried 4-0-1 with Betsy Stolfa abstaining.
6. CITY STRATEGY No. 1: Provide high quality infrastructure and services in a planned fiscally responsible manner.
A. Consider Resolution R-09-15 approving a Cooperative Agreement with the Minnesota Department of Transportation.
1. Approve Resolution R-09-15 that the City of Delano enter into MnDOT Agreement No. 94202 with the State of Minnesota, Department of Transportation.
Motion Number (M-09-144) Motion by Brad Hotchkiss, seconded by Holly Schrupp to adopt Resolution R-09-15 to enter into MnDOT Agreement No. 94202 with the State of Minnesota, Department of Transportation. Motion Carried 5-0 by Roll Call Vote.
B. Consider dog park and licensing fees.
C. Review 2009 Seal Coat Project and consider quote.
Motion Number (M-09-145) Motion by Betsy Stolfa, seconded by Holly Schrupp to approve the 2009 Seal Coat Project and approve quotes received from Pearson Brothers Inc. Motion Carried.

Motion Number (M-09-137) Motion by Larry Bartels, seconded to Holly Schrupp to refer this parcel to the County Assessor for further discussion. Motion Carried.

Council Member Hotchkiss called the special workshop of the Delano City Council/ Economic Development Authority of Tuesday, April 28, 2009 to order at 6:05 PM.
2. ROLL CALL
Members Present: Joe McDonald, Mayor (7:00 PM); Holly Schrupp, Council Member (6:10 PM); Brad Hotchkiss, Council Member; Larry Bartels, Council Member; Betsy Stolfa, Council Member.
Members Absent: None.
Also Present: Phil Kern, City Administrator; Brian Bloch, Finance Director; Ernie Eden, Public Works Director; Paula Bauman, Recorder.
3. SPECIAL ORDER OF BUSINESS
A. Discuss Rivertown Project.
Staff discussed the Commercial and Residential Units in the Rivertown Project. Bloch reviewed the first quarter financials on the commercial and residential properties; while reviewed the revenue and expenditures for the commercial property.
B. Discuss Industrial opportunities.
Kern stated the City is interested in examining alternative locations for potential industrial land uses. Kern reviewed the alternative locations while discussing the pros and cons of each potential site. Council discussed the options and agreed a study on the potential locations should be done.
C. Discuss hotel project.
Kern stated the property owner is representing that construction is ready to be started on the Comfort Inn by middle of summer and open spring of 2010. The developers spoke with Staff last week who stated they need to come up with thirty percent cash equity and are asking the City for subsidy assistance. Staff will be in contact with the City’s financial advisory, Springstead, for further assistance.
D. Discuss Park and Recreation projects.
Kern reviewed the proposed Barb King Memorial Park which has been proposed for the Woodland Meadows development.
