TO ALL INTERESTED PARTIES, GROUPS AND PERSONS:
The purpose of this notice is to identify two separate but related actions to be taken by the City of Winsted (hereinafter referred to as the Grantee).
One, the Grantee has made a Finding of No Significant Impact on project activities (see the Finding of No Significant Impact, below) and two, they propose to request the Business and Community Development Division, Small Cities Development Program, Minnesota Department of Employment and Economic Development (DEED), to release Federal funds (see Notice of Intent to request Release of Funds, below) under Title I of the Housing and Community Development Act of 1974, as amended (PL 98-181) for the following project:
Winsted/Mayer Comprehensive Project. Activities will include Commercial and Rental Rehabilitation and the related administrative costs. The total project costs are estimated to be $699,315, of which the SCDP grant will be $397,536. Project activities will occur in the following locations:
Mayer: An approximate twelve (12) block area of the Central Business District that runs along Highway 25 (Ash Street) from 7th Street on the north side, to County Road 30 on the south and approximately one half block to the east and one to two block west.
Winsted: An approximate four (4) block area of the Central Business District that runs along Main Avenue West from Sixth Street South to Winsted Lake and approximately one half to one and a half blocks on either side of Main Avenue West.
Finding of No Significant Impact
It has been determined such request for release of funds will not constitute an action significantly affecting the quality of the human environment and the Grantee has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).
The reasons not to prepare an Environmental Impact Statement are as follows:
1. There will be no negative impacts on historic properties. Submission procedures will be followed for State Historic Preservation Office and interested Tribes when applicable. Rehabilitation of historic properties will be done in accordance with the Secretary of the Interior’s Standards for Rehabilitation in consultation with MnSHPO.
2. There will be no negative impacts on Floodplains as no activities are proposed to occur on properties located within a floodplain.
3. There will be no negative impacts on Wetlands as no activities are minor and will occur only on structures and not affect Wetlands.
4. Some increases in noise, dust and nuisance levels may occur during construction, however, such disturbances will be temporary and will cease upon completion of the project.
5. Individual projects will be evaluated for negative impacts from thermal/explosive hazards, airport clear zones or landfill, toxic sites and will be remediated if possible.
6. Minor rehab activities will not affect any navigable waters and a state approved wellhead protection plan will be followed for affected project activities.
7. Minor rehab will not generate regulated waste and lead debris generated by rehab activity will be disposed of according to safe lead abatement practices.
8. There are no endangered species, farmlands, wild and scenic rivers or coastal zones located in the proposed project area(s)
9. Rehabilitation activities will improve environmental living conditions for low income people.
In accordance with 24 CFR Part 58.15, a tiered review process has been structured for the rehabilitation, whereby some environmental laws and authorities have been reviewed for the target area and other applicable laws and authorities will be complied with, when participating properties have been identified and projects are ripe for review. Specifically, the target area has been studied and compliance with the following laws and authorities has been established: wetland protection, sole source aquifers, endangered species, wild and scenic rivers, coastal zone management, floodplain management, air quality, farmlands protection, airport runway clear zone requirements and environmental justice.
Compliance with the following laws and authorities will take place once properties within the target area have been identified, but prior to the commitment of funds: historic properties and HUD environmental standards for hazards. By direct contact and with this notice and other opportunities for public participation, the Grantee intends to fulfill the consultation requirements of Section 106 of the National Historic Preservation Act. Compliance documentation on the aforementioned laws and authorities will be in each individual property file, and copies will be available, once established, at Heartland Community Action Agency, 200 SW 4th Street, PO Box 1359, Willmar, MN 56201.
In addition, pursuant to the National Historic Preservation Act, comments on the identification and treatment of historic properties in the project area are welcome.
An Environmental Review Record respecting this project has been made by the Grantee that documents the environmental review of the project and fully sets forth the reasons why such statement is not required. The Environmental Review Record is on file and is available for public examination and copying, upon request, at City of Winsted, 183 Main Avenue West, PO Box 126, Winsted, MN 55395-0126, between the hours of 8:00 a.m. and 4:30p.m.
No further environmental review of this project is to be conducted before the request for release of federal funds.
Public Comments on Finding
All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the Grantee to the preparing agency at: David Drown Associates, Attn: Traci Ryan, 211 Oak Street South, Sauk Centre, MN 56378 on or before July 15, 2009. All comments received will be considered and the Grantee will not request the release of federal funds or take any administrative action on this project before the date specified in the preceding sentence.
Notice of Intent to Request Release of Funds
On or about July 15, 2009, the Grantee will request the Business and Community Development Division, Small Cities Development Program, Minnesota Department of Employment and Economic Development (DEED), to release Federal funds under Title I of the Housing and Community Development Act of 1974, as amended (PL 98-181) for the project described above.
The Grantee will undertake the project described above with Block Grant funds from DEED under Title I of the Housing and Community Development Act of 1974. The Grantee is certifying to DEED that Steve Stotko, in his official capacity as the Mayor of Winsted, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Grantee may use Block Grant funds and DEED and the U.S. Department of Housing and Urban Development will have satisfied their responsibilities under the National Environmental Policy Act of 1969.
Objections to State Release of Funds
BCD will accept objections to its approval of the release of funds and acceptance of the certification for a period of 15 days following the anticipated submission date or its actual receipt of the request, whichever is later, only for one of the following reasons: (a) that the certification was not in fact executed by the Chief Executive Officer or other officer of the Grantee approved by BCD; (b) that the Grantee’s ERR for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process; (c) the Grantee or its agents have incurred costs not authorized at 24 CFR Part 58.22 before approval of a release of funds by BCD; or (d) another Federal agency acting pursuant to 24 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
