Mayor Joe McDonald called the regular meeting of the Delano City Council/Economic Development Authority of Tuesday, December 15, 2009 to order at 7:00 PM.

A. Adopt a RESOLUTION (EDA-09-06) approving the Implementation of a Delano EDA/Crow River Villa Stimulus Recovery Grant number MN 4S062501-09 dated December 15, 2009.

CITY
B. Consider Employee Salary and Benefit changes for 2010.
Motion Number (M-09-298) Motion by Brad Hotchkiss, second by Larry Bartels to approve the Employee Salary and Benefit changes for 2010. Motion carried; Holly Schrupp abstained.
C. Authorize membership with the Wright County Economic Development Partnership.
D. Approve the Social Media Policy relating to public comments.

E. Authorize solicitation of Request for Proposals for the Delano Village Hall.

6. CITY STRATEGY No. 1: Provide high quality infrastructure and services in a planned fiscally responsible manner.
A. Adopt RESOLUTION (R-09-35) of the Final 2009 payable 2010 Tax Levy for the City of Delano.
Motion Number (M-09-301) Motion by Larry Bartels, second by Brad Hotchkiss to approve Resolution (R-09-35) of the Final 2009 payable 2010 Tax Levy for the City of Delano. Motion carried 4-0 by Roll Call Vote.
B. Adopt RESOLUTION (R-06-36) for the 2010 Budget for the City of Delano.
Motion Number (M-09-302) Motion by Brad Hotchkiss, second by Holly Schrupp to approve Resolution (R-09-36) for the 2010 Budget for the City of Delano. Motion carried 4-0 by Roll Call Vote.
C. Adopt RESOLUTION (R-09-37) implementing the Capital Improvement Plan for 2010 – 2014 for the City of Delano.
Motion Number (M-09-303) Motion by Larry Bartels, second by Holly Schrupp to approve Resolution (R-09-37) implementing the Capital Improvement Plan for 2010 – 2014 for the City of Delano. Motion carried 4-0 by Roll Call Vote.
7. CITY STRATEGY No. 2: Ensure the City’s financial stability.
A. Adopt RESOLUTION (R-09-38) establishing 2010 sanitary sewer user fees.
Motion Number (M-09-304) Motion by Larry Bartels, second by Holly Schrupp to adopt RESOLUTION (R-09-38) establishing 2010 sanitary sewer user fees of implementing option number three. Motion carried 4-0 by Roll Call Vote.
B. Motion to approve a three year contract for janitorial services beginning January 1, 2010 for the City Hall, Senior Center, Library, and Community Center.
Motion Number (M-09-305) Motion by Brad Hotchkiss, second by Larry Bartels to award the three year contract for janitorial services to ProCare Services due to the reference check results submitted to Council on Tuesday, December 15, 2009. Motion carried.
8. CITY STRATEGY No. 3: Manage high quality growth consistent with the City’s Comprehensive Plan.
A. Consider a request from Marc Gillet owner of the property dba MAJG LLC, of the property located at 901, 903 and 905 Babcock Boulevard, for a Conditional Use Permit for an Automobile and Truck Repair Business (including body shops) for the properties legally described as Exhibit A to the City of Delano (PID Number 107500-131201) in accordance with the City’s Zoning and Land Use Code Chapter 51.21, Subd.D.1.
1. Approve RESOLUTION (R-09-39) for a conditional use permit to allow auto and truck repair at 901-905 Babcock Boulevard within the City of Delano, Minnesota.

9. CITY STRATEGY No. 4: Ensure a well-trained and productive workforce to meet the changes of the City.
A. Consider Personnel Policy Amendments.
Motion Number (M-09-308) Motion by Holly Schrupp, second by Brad Hotchkiss to approve the submitted Personnel Policy Amendment and require the word “supplemental” added to the current policy. Motion carried.
10. CITY STRATEGY No. 5: Increase accountability by measuring and evaluating service delivery.
11. CITY STRATEGY No. 6: Continue to improve the City’s downtown.
12. CITY STRATEGY No. 7: Encourage communication and ideas with residents and business owners.
A. Appoint an official newspaper for Legal Advertisements.

13. OTHER BUSINESS
A. Attorney/Client Privilege: Discuss potential litigation with Anchor Properties, LLC.

A. City Claims.
Motion Number (M-09-312) Motion by Brad Hotchkiss, second by Holly Schrupp to approve the City Claims in the amount of $393,039.59. Motion carried.
B. Claims List of the Delano EDA/Crow River Villa Apartments for the month of November 2009.
Motion Number (M-09-313) Motion by Holly Schrupp, second by Larry Bartels to approve the Claims List of the Delano EDA/Crow River Villa Apartments for the month of November 2009 in the amount of $4,959.89. Motion carried.
16. ADJOURNMENT

3. SPECIAL ORDER OF BUSINESS
A. Discuss Commission and Committee Requirements.
Council discussed Commission terms and non-resident participation. Council decided to not take any further action regarding changing code requirements at this time.
B. Interview Candidates.
(1) Water, Light and Power Commission:
Motion Number (M-09-314) Motion by Brad Hotchkiss, second by Betsy Stolfa to appoint Joseph Johnson to the vacant position on the Delano Water, Light and Power Commission with the term expiring December 31, 2010. Motion carried.
Motion Number (M-09-315) Motion by Holly Schrupp, second by Betsy Stolfa to re-appoint Randy Keranen on the Delano Water, Light and Power Commission with the term expiring December 31, 2012. Motion carried.
(2) Planning Commission:
Motion Number (M-09-316) Motion by Betsy Stolfa, second by Holly Schrupp to appoint Amy Stewart to the vacant position on the Planning Commission with the term expiring December 31, 2012. Motion Carried.
Motion Number (M-09-317) Motion by Brad Hotchkiss, second by Betsy Stolfa to re-appoint Howard Glas on the Planning Commission with the term expiring December 31, 2012. Motion Carried.
(3) Park and Recreation Commission:
Motion Number (M-09-318) Motion by Brad Hotchkiss, second by Betsy Stolfa to appoint Dan Menk to the vacant position on the Park and Recreation Commission with the term expiring December 31, 2011. Motion Carried.
Motion Number (M-09-319) Motion by Betsy Stolfa, second by Brad Hotchkiss to re-appoint Mike Lindquist and Heather Motzko on the Park and Recreation Commission with the terms expiring December 31, 2012. Motion Carried.
(4) Public Safety Commission:
Motion Number (M-09-320) Motion by Holly Schrupp, second by Brad Hotchkiss to remove Paul Schmidt from Public Safety Commission citing Mr. Schmidt’s dissatisfaction with the results and operations of the Public Safety Commission. Motion Carried.
Motion Number (M-09-321) Motion by Betsy Stolfa, second by Brad Hotchkiss to appoint Shirleen Hoffman on the Public Safety Commission with the term expiring December 31, 2012. Motion Carried.
Motion Number (M-09-322) Motion by Betsy Stolfa, second by Brad Hotchkiss to appoint Scott Bohler on the Public Safety Commission with the term expiring December 31, 2012. Motion Carried.
Motion Number (M-09-323) Motion by Brad Hotchkiss, second by Betsy Stolfa to appoint Allen Rasmussen on the Public Safety Commission with the term expiring December 31, 2011. Motion Carried.
(5) Historic Preservation Commission:
Motion Number (M-09-324) Motion by Holly Schrupp, second by Brad Hotchkiss to re-appoint Marla Frach and Brad Bruhn on the Historic Preservation Commission with terms expiring December 31, 2012. Motion Carried.
