CITY OF COKATORESOLUTION NO. 2010-11RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 05-2010 BY TITLE AND SUMMARY
WHEREAS, the city council of the city of Cokato has adopted Ordinance No. 05-2010, an ordinance amending the city’s code of ordinances regarding the regulation of tattooing, body piercing and body art; and
WHEREAS, Minnesota Statutes, §412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances of those containing charts or maps; and
WHEREAS, the ordinance is two pages in length; and
WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Cokato that the city clerk shall cause the following summary of Ordinance No. 05-2010 to be published in the official newspaper in lieu of the entire ordinance:
Public Notice
The city council of the city of Cokato has adopted Ordinance No. 05-2010, an ordinance amending the city’s code of ordinances regarding the regulation of tattooing, body piercing and body art. The ordinance repeals the majority of the city’s ordinance regarding this subject because state law now provides for state licensing of body art technicians and the establishments in which such activities are conducted and sets the health and safety standards which apply. The city retains a limited role by restricting the locations where such uses may take place. A site is not eligible if taxes or other governmental charges are owed; if it is not properly zoned; if alcohol may be served or if it is an adult establishment; or if it is within 300 feet of prescribed uses, including places of worship, schools, day cares, residences, pawnshops, massage parlors, or other tattoo, body piercing or body art establishments. The full text of Ordinance No. 05-2010 is available for inspection at Cokato city hall during regular business hours.

BE IT FURTHER RESOLVED by the city council of the city of Cokato that the city clerk keep a copy of the ordinance in her office at city hall for public inspection and that she post a full copy of the ordinance in a public place within the city.
