NOTICE OF HEARING ON PROPOSED ASSESSMENT
CITY OF NEW GERMANY
NORTHWEST AREA UTILITY AND STREET IMPROVEMENT PROJECT
NOTICE IS HEREBY GIVEN PURSUANT TO MINNESOTA STATUTES 429.061, SUBD. 1:
1. A hearing will be held by the City Council of the City of New Germany on Wednesday, November 3, 2010, at 7:00 p.m. in the Council Chambers of the New Germany City Hall, 300 Broadway Street, New Germany, Minnesota 55367, to review and consider the proposed assessment for the Northwest Area Utility and Street Improvement Project.
2. This improvement project consists of the making of public improvements in the City of New Germany generally described as follows:
Utilities. Sanitary Sewer and Watermains. Extension of trunk sanitary sewer and trunk watermain from existing sewer and water on Black Forest Road north to 62nd Street, thence west along 62nd Street to the west driveway of the Trophy Lake Estates IV Development. Installation of sewer and water stubs along 62nd Street for future service when properties are annexed.
Extension of watermain from proposed main at intersection of CSAH No. 33/State Avenue and 62nd Street south to existing watermain near Manning Street and extension of watermain from intersection of CSAH No. 30/Broadway Street south along Adams Avenue to the Robert Roepke/St. Mark School property.
Street. Construction of a 24 foot wide bituminous street east along 62nd Street from the west line of Trophy Lake Estates to the future intersection of Black Forest Road.
according to the plans and specifications prepared for such improvement project.
3. The adoption of the proposed assessment by the Council may be taken at the hearing.
4. The area to be assessed is the property abutting this improvement.
5. The proposed assessment roll is on file with the City Clerk and open to public inspection.
6. The total amount of the proposed assessment is $1,191,785.39.
7. Written or oral objections by any property owner will be considered at this hearing. No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The Council may consider any written objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owner as it deems advisable.
8. An owner may appeal an assessment to District Court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City of New Germany within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after the service upon the Mayor or Clerk.
9. The assessment is proposed to be payable in equal annual installments extending over a period of 20 years. The first installment shall be payable on or before the first Monday in January 2011, and will bear interest at the rate of 5.5% per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2011. To each subsequent installment when due shall be added interest for one year on all unpaid installments.
10. The owner of any property assessed may, at any time prior to the certification of the assessment to the County Auditor, prepay to the New Germany City Clerk the entire assessment on such property with interest accrued to the date of payment, except that no interest will be charged if the entire assessment is paid within thirty (30) days from the adoption of the assessment.
11. After certification of the assessment roll to the County Auditor, the property owner may at any time, prior to November 15th of any year, prepay to the New Germany City Clerk the entire principal balance of the assessment remaining, except that the installment of principal and interest in process of collection on the current property tax list for the year in which the prepayment is made shall be paid to the Carver County Treasurer as part of the real estate taxes for the property assessed and payable for that year. If prepayment is made after November 15th of any year, interest will be charged to December 31st of the next succeeding year.

Public Accuracy Test
General Election
Please take notice that the City of Waverly will be performing the required public accuracy test for the optical scan equipment on Monday, October 25, 2010 at 11:00 a.m. at Waverly City Hall, 502 Atlantic Avenue, Waverly, Minnesota.
The required testing of the equipment is to ensure that the system is operating accurately and tabulation of the votes are consistent with a manual listing of votes for candidates prepared by the State of Minnesota specifically for the testing.
The public is welcome to attend the testing of the optical scan equipment.
