NOTICE OF HEARING ON PROPOSED ASSESSMENT
Notice is hereby given that the City Council of the City of Howard Lake, Minnesota, will meet at 7:00 p.m. on the 16th day of November, 2010, or soon thereafter at the Howard Lake City Hall, 625 8th Avenue, Howard Lake, Minnesota, to pass upon the proposed assessment of costs related to the installation of streets, curb, gutter, and related municipal improvements abutting properties located in the plat of Dutch Lake Preserve, Howard Lake, Minnesota. The properties proposed to be assessed are located in the plat of Dutch Lake Preserve in the City of Howard Lake, Minnesota and are described as follows:
• Lots 3-8, Block 1.
• Lots 1-4, Block 2.
• Lots 1 & 3, Block 3.
• Lot 1, Block 4.
• Lot 1, Block 5.
The proposed assessment roll is on file for public inspection in the City Clerk’s office at City Hall. The total amount of the proposed assessment is $257,044.45. Adoption of the proposed assessment by the City Council may be taken at the hearing. Written or oral objections to the proposed assessments by any property owner will be considered at the meeting. No appeal may be taken as to the amount of the assessment unless a written objection, signed by the property owner, is filed with the City Clerk prior to the hearing or presented to the presiding officer at the hearing.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statutes Section 429.081 by serving written notice of the appeal upon the Mayor or City Administrator within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or City Clerk.
Minnesota Statutes Section 435.193 through 435.195 authorize a municipality to defer the payment of assessments against homestead property owned by persons 65 years of age and older, or who are retired because of permanent and total disability under circumstances where it would be a hardship for such person to make the assessment payments. When deferment of the special assessment has been granted and is terminated for any reason provided in that law, all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law and Howard Lake’s ordinances may, within 30 days of the confirmation of the assessment, apply to the City Clerk on the prescribed form for such deferral of payment of this special assessment on said owner’s property.

YOU ARE NOTIFIED THAT:
1. Default has occurred in the conditions of the Mortgage dated December 22, 2003, executed by Peter R.
