Notice of Hearing on Proposed Assessment
Notice is hereby given that the City Council of the City of Waverly, Minnesota will meet at 7:00 p.m. on November 23, 2010 to consider the proposed assessment for the 2010 Waverly Development Corrections, the completion of the roads and punchlist items of the Carrigan Meadows 3rd Addition, Carrigan Estates 1st, 2nd and 3rd Additions, Windgate at Carrigan Lake Addition, Woodland Shores 1st and 2nd Additions and Waverly Industrial Park developments. The total amount of the proposed assessment is $374,656.90. The total cost of the project is $524,656.90.
The proposed assessment roll is on file with the City Clerk and is open to public inspection. Written or oral objections will be considered at the hearing.
No appeal may be taken as to the amount of any assessment adopted pursuant to Minnesota Statutes, Section 429.061, Subdivision 2, unless written objection signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. An owner may appeal an assessment to District Court pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or Clerk.
An owner may request deferment of an assessment pursuant to Minnesota Statutes, Section 435.193 to 435.195 for any homestead property owned by a person 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments or owned by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service, as defined in section 190.05, subdivision 5b or 5c, as stated in the person’s military orders, for whom it would be a hardship to make the payments.
