CITY OF COKATO, MINNESOTA
NOTICE OF PUBLIC HEARING ON THE ISSUANCE OF REVENUE REFUNDING BONDS UNDER MINNESOTA STATUTES, CHAPTER 462C, AS AMENDED
NOTICE IS HEREBY GIVEN that the City Council of the City of Cokato, Minnesota (the “City”), will meet on Tuesday, November 13, 2012, at or after 7:00 p.m. at City Hall, 255 Broadway Avenue, in the City for the purpose of conducting a public hearing on a proposal that the City Council approve and authorize the issuance by the City of one or more series of revenue refunding bonds (the “Bonds”) under Minnesota Statutes, Chapter 462C, as amended (the “Act”).
Cokato Charitable Trust, a Minnesota charitable trust (the “Borrower”), has requested that the City issue the Bonds pursuant to the Act to (i) refund the City’s outstanding Senior Housing Revenue Bonds (Cokato Charitable Trust Project) Series 2004 (the “Prior Bonds”), originally issued in the aggregate principal amount of $5,185,000; (ii) fund a debt service reserve fund or other reserves for the Bonds; and (iii) pay a portion of the costs of issuance with respect to the Bonds. The Prior Bonds were used to refinance improvements to (i) Edgewood Gables, a 30-unit congregate rental facility for elderly persons located at 600 3rd Street SE in the City, which is owned and operated by the Borrower, and (ii) Cokato Manor, a nursing home with 66 beds and 10 Alzheimer beds located at 182 Sunset Avenue in the City, which is also owned and operated by the Borrower.
Following the public hearing, the City will consider adoption of a resolution granting approval for the issuance of the Bonds. The aggregate face amount of the Bonds proposed to be issued is presently estimated not to exceed $4,200,000. The Bonds may be issued in one or more series. The Bonds to be issued by the City will constitute special, limited obligations of the City payable solely from the revenues expressly pledged to the payment thereof, and will not constitute a general or moral obligation of the City, and will not be secured by the taxing powers of the City or any assets or property of the City. Before issuing the Bonds, the City will enter into an agreement with the Borrower whereby the Borrower will be required to make payments at least sufficient at all times to pay the principal of and interest on the Bonds when due.
All persons interested may appear and be heard at the time and place set forth above or may file written comments with the City Administrator prior to the date of the hearing set forth above.
