ORDINANCE NO. O-13-06
AN ORDINANCE AMENDING CITY CODE CHAPTER 3, SECTION 301.01 RELATING TO RIGHT OF WAY MANAGEMENT BY ADDING PROPERTY OWNER NOTICE PROVISIONS.
The City Council of the City of Delano ordains:
Section 1. City Code Section 301.01, Subd. 5 is hereby amendied by adding L, which reads as follows:
L. A copy of the notice provided to property owners required by Section 310.01, Subd. 11 (F).
Section 2. City Code Section 301.01, Subd. 11 is hereby amended by adding F, which reads as follows:
F. Property Owner Notice. The permittee shall provide three days written notice prior to any activities that require an excavation permit under this Section to everyone who owns property within 75 feet of the work to be performed. The permittee shall provide a copy of the notice sent to the City along with the permit application. The written notice shall include the following: contact information for the permittee, the nature of the work being done, possible planned service interruptions, anticipated construction dates including duration of work, and a map or graphic showing the location of the work relative to the properties.
Section 3. This ordinance shall become effective from and after its passage and publication.

3. SPECIAL ORDER OF BUSINESS
A. Interview and appoint candidates for the Park and Recreation Commission.
Motion Number (M-13-212) Motion by Derek Schansberg, seconded by Dan Vick to appoint Merle Wagner to the Park and Recreation Commission with the term expiring February 28, 2014. Motion Carried.
B. Discuss Delano Wine and Spirits lease.
Delano Wine and Spirits current lease at the Delano Crossings expires January 31, 2014. The new lease terms were presented proposed that the liquor store expand in to the existing space to the west.
C. Discuss City Compensation Plan and Step System.
Staff is proposing a change in awarding merit increases for part-time employees. Instead of being eligible for a step increase at 2,080 hours, staff is recommending that part-time employees be eligible for a step increase after two years of employment once they have accumulated 1,040 work hours.
D. Review 2014 Budget and Tax Levy.
Brian Bloch reviewed the memo dated September 24, 2013. Discussion focused on Special Revenue Funds, all Capital Project Funds and the two Enterprise Funds.

1. Adopt Resolution approving the preliminary and final plat for a subdivision entitled “Delano Northwest Business Park” within the City of Delano, Minnesota.
Motion by John “Jack” Russek, seconded by Derek Schansberg to adopt Resolution Number R-13-30 approving the preliminary and final plat for a subdivision entitled “Delano Northwest Business Park” within the City of Delano, Minnesota subject to the terms and conditions listed within the Planner’s Reports dated July 3, 2013 and August 7, 2013 and subject to execution of all development agreements. Motion carried, Betsy Stolfa absent.
2. Adopt an Ordinance amending the Delano Zoning Map of the City of Delano, Minnesota.
Motion by Derek Schansberg, seconded by John “Jack” Russek to adopt Ordinance Number O-13-03 amending the Delano Zoning Map of the City of Delano, Minnesota subject to the planner’s reports dated July 3, 2013, and August 7, 2013, and further subject to execution of all development agreements. Motion carried. Betsy Stolfa absent.
B. Discuss request from Shawn Kirschner, of Delano Retail (aka Verizon) and Lobeco LLC, for an Administrative Subdivision, a Site and Building Plan review, and an amendment to the existing Planned Unit Development (PUD) to allow for shared parking and access, for property located at 1045 Crossings Drive.
1. Adopt Resolution approving site and building plans for the Verizon retail building in the City of Delano, Minnesota.
Motion by Dan Vick, seconded by John “Jack” Russek, to adopt Resolution Number R-13-31 approving site and building plans amendment to the existing Planned Unit Development (PUD) to allow for shared parking and access, and the minor subdivision for the Verizon retail building in the City of Delano, Minnesota. C. Consider request from Delano Area Sports Arena and the Delano Public Schools located at 654 Tiger Drive, for a conditional use permit for public and semipublic recreation buildings and facilities, and for an exception to the exterior building elevations to allow for a metal building in an R-2 Residential District.
1. Adopt Resolution approving conditional use permits for the construction of a public semi-public recreational building and an exception to the exterior building elevation material in an R-2, Single Family Residential District to construct a second ice arena at 654 Tiger Drive within the City of Delano, Minnesota.
Motion by Derek Schansberg, seconded by Dan Vick to Adopt Resolution Number R-13-32 approving conditional use permits for the construction of a public semi-public recreational building and an exception to the exterior building elevation material in an R-2, Single Family Residential District to construct a second ice arena at 654 Tiger Drive within the City of Delano, Minnesota. Motion carried.
D. Consider text amendment to the City of Delano Land Use and Zoning Code and Alcoholic Beverages Code to allow for Brew Pubs and Growlers licenses as Conditional Use Permits in the B-4, Central Business District.
1. Adopt an Ordinance amending Delano Zoning Ordinance Section 51.01 Subd. B rules and definitions and Section 51.23 B-4, Central Business District, as pertains to Brewpubs in the City of Delano.
Motion by Derek Schansberg, seconded by Dan Vick to adopt an Ordinance Number O-13-04 amending Delano Zoning Ordinance Section 51.01 Subd. B rules and definitions and Section 51.23 B-4, Central Business District, as it pertains to Brewpubs in the City of Delano. Motion carried.
2. Adopt an Ordinance amending Delano City Code Chapter 5 Licensing and Regulation of Alcoholic Beverages, to regulate the provision of a Brewpub On-Sale/Off-Sale Liquor License within the City of Delano.
Motion by John “Jack” Russek, seconded by Dan Vick to Adopt an Ordinance Number O-13-05 amending Delano City Code Chapter 5 Licensing and Regulation of Alcoholic Beverages, to regulate the provision of a Brewpub On-Sale/Off-Sale Liquor License within the City of Delano. Motion carried.

3. SPECIAL ORDER OF BUSINESS
A. Discuss Xcel Energy building – 10 West Bridge Avenue.
Motion Number (M-13-178) Motion by Betsy Stolfa, seconded by Derek Schansberg to approve the reuse plan contingent on agreement and approval of final numbers. Motion carried with Jack Russek opposed.
B. Discuss Northwest Business Park.
Staff’s recommendation to continue with the project is to enter into a short-term agreement with Murphy and work on a longer-term extension. For upcoming meetings; Staff would recommend authorizing bids at the August 6, 2013, and consider land use approvals at the August 20, 2013. and prepare for an agreement with user by August 31, 2013.
C. Review field scheduling procedures.
Staff has been working with the school to create an online system of scheduling fields. Staff will present the program and updated agreements at an upcoming meeting. No motion taken.
D. Discuss Ice Arena project and financing request.
Council reviewed the plans for the Delano Ice Arena project.
E. Discuss Independence request to meet regarding utilities.
The City of Independence has requested further discussion with City officials in regards to the City of Delano providing utilities to a site east of the City limits. Council felt at this time to decline further discussions regarding utilities.
F. Discuss organizational staffing study.
Staff discussed the potential opportunities over the next few years in regards to staffing level changes, merging some services and equipment.
G. Consider purchase offer for Rivertown Commercial Building, 203 Bridge Avenue East. (This item may be closed for discussion.)
This item was removed from the agenda.
H. Discuss dog issue at 3521 County Road 30 SE.
Phil Kern stated this issue is still ongoing. Staff will keep Council up-to-date on this issue as needed.
