Regular Meeting of the Board of Education
Independent School District 879, Delano Public Schools
The regular meeting of the Board of Education of Independent School District 879, Delano, Minnesota, was held on Monday, October 28, 2013, at Delano City Hall. The meeting was called to order by the chair at 7:01 p.m. with the following members in attendance: Johnson, Milano, Durick, Black, Larson, Seguin, Baker.
APPROVAL OF MEETING AGENDA (approved unanimously)
Before approval of meeting agenda, R. Durick asked to add the November 25 School Board meeting date to the agenda. M. Larson and L. Seguin asked to strike the DASA Meeting and Curriculum Advisory Council meeting off the agenda because they did not take place.
PROGRAM REVIEW
J. Vieau presented the MCA/MMR results and the 2012-13 Annual Report
CONSENT AGENDA (approved unanimously)
Board approved the regular meeting minutes of 9-23-13 and the special meeting minutes of 10-10-13. The current budget status with year-to-date adjustments, investment transactions, wire transfers, Minnesota Liquid Assets fund, cash report, revenue and expense fund totals, expense reports and disbursements.
RESOLUTION FOR ACCEPTANCE OF GIFTS (approved unanimously)PERSONNEL (approved unanimously):
Board approved retirements/resignations/terminations, recommendations of employment which include; resignation of DES Recess Paraprofessional, DHS 9th Grade Boys Basketball coach, CE Instructor/Coach. Recommendation of employment include: DES Recess Paraprofessional, DES ECSE Paraprofessional, (2) DMS/DHS Food Service workers, DES Long-Term Substitute teacher, DHS 9TH Grade Boys Basketball coach, (2) CE Volleyball assistant coach, CE Yoga instructor, CE Lifeguard Aide, CE Swim Lesson aide, (2) CE Youth Football coach, CE Youth Football coach/coordinator, CE Youth Football Coach and Tiger Strength Coach; Memorandum of Agreement for Custodian and Maintenance Employee Group, changing paid holiday for 2013-14 school year; Leaves of Absence approved for DES 1st Grade teacher, DMS Physical Education teacher, DMS Special Education teacher, DMS 7th Grade Mathematics teacher, DMS Phy. Ed./DAPE/Health teacher.
ADMINISTRATIVE AND BOARD REPORTS
Board heard the following administrative reports: Superintendent Schoen reported on Delano Public Schools being recognized by Forbes magazine and Delano Elementary being chosen a 2013 National Blue Ribbon School. DMS Principal Ms. Klinkner reported on the 2013-2014 DMS School Improvement Plan; DHS Principal Dr. Heil reported on the 2013-14 DHS School Improvement Plan; DES Principal Mr. Shuler reported on the 2013-14 DHS School Improvement Plan, receiving the Reward School designation and being named a 2013 National Blue Ribbon School; Business Manager M. Reeder reported on the approved proposed operating levy; Community Education Director Ms. Johnson reported on the 2013-14 CE Improvement Plan and last year’s improvement plan results; Student Board Representatives Alex Grant and Abby Hutchins reported on student involvement and activities around the district.
Board heard reports from board members regarding MAWSECO, Wright Technical Center, Schools for Equity in Education (SEE), Safe Schools, and Staff Development.
OLD BUSINESS (approved unanimously)
Second reading of policies due to substantive and/or legal reference changes: Policy 406-Public and Private Personnel Data, Policy 417-Chemical Use and Abuse, Policy 509-Enrollment of Nonresident Students, Policy 515-Pupil Records, Policy 528-Student Parental, Family and Marital Status Nondiscrimination, Policy 610-Field Trips, Policy 711-Video Recording on School Buses, Policy 712-Video Surveillance Other Than on Buses.
NEW BUSINESS (approved unanimously)
First and only read of policy due to non-substantive and/or legal reference changes: Policy 614-School District Testing Plan and Procedure; 2013-14 Q-Comp Plan; first read of policies due to substantive and/or legal reference changes Policy 215-Student School Board Representatives, Policy 425-Professional Development, Policy 601-Goals and Objectives of the Education Program, Policy 616- School District System Accountability, Policy 618-Assessment of Student Achievement, Policy 620-Credit for Learning, Policy 624-On-Line Learning Options; Surplus property disclosed; November School Board work session and regular meeting were changed from Monday, November 25, at Delano City Hall to Monday, November 18, in the Delano High School Media Center. The School Board work session begins at 5:45 p.m. and the regular meeting begins at 7:00 p.m.
The meeting adjourned at 9:09 p.m. The preceding is a summary of the unofficial minutes. 1. CALL TO ORDER
Mayor Graunke called the special workshop of the Delano City Council/Economic Development Authority of Tuesday, October, 2013 to order at 7:00 p.m.
2. ROLL CALL
Members Present: Mayor, Dale Graunke; Councilmembers Betsy Stolfa, Dan Vick, Derek Schansberg, and Jack Russek
Members Absent: None
Also Present: Phil Kern, City Administrator; Mark Johnson, City Attorney; Bob Van Lith, Fire Department Chief; Nancy Drumsta, Delano Wine and Spirits Manager; Devin Massopust, Administrative Intern;
3. SPECIAL ORDER OF BUSINESS
A. Conduct Public Hearing and consider business subsidy for Grandstay hotel.
Motion Number (M-13-251) Motion by Dan Vick, seconded by Betsy Stolfa to open the meeting for a public hearing considering a public subsidy for the Grandstay Hotel. Motion carried.
Mayor Graunke called for public comment three times. None was heard.
Motion Number (M-13-252) Motion by Jack Russek, seconded by Betsy Stolfa to close the public hearing. Motion carried.
Motion Number (M-13-253) Motion by Betsy Stolfa, seconded by Dan Vick to approve business subsidy agreement between the City of Delano and Delano Hotel Partners LLC. Motion carried.
B. Discuss and consider agreements for Northwest Business Park project.
Motion Number (M-13-254) Motion by Jack Russek, seconded by Betsy Stolfa to complete execution of closing on Northwest Business Park Project. Motion carried.
C. Discuss Fire Department officer selection process.
Chief Van Lith updated the Council on the current process for the selection of officers and stressed that a position’s job duties and requirements are important for running an effective and efficient department. Chief Van Lith informed the Council that the selection process for officers of the Fire Department always have to be approved by the Council, but it is how they get to that point where there is a hold up.
D. Discuss Delano Wine and Spirits lease options.
Nancy Drumsta, Delano Wine and Spirits manager, gave an update on the total costs and revenue without expansion and with changes to the requested beer cooler before the store.
E. Discuss 10 W. Bridge Avenue Renovation (former Xcel Building)
Kern gave an update on the current project at the Xcel Building in terms of budget.
F. Discuss DASA/DAHA hockey proposals and City/School lease agreement.
Phil updated the Council on how DASA/DAHA wants a second sheet of ice southwest of the current ice arena building, but are not going forward with the project this Fall as intended like. Kern told the Council that the group was presented with a Springsted work plan and have that under consideration now.
4. ADJOURNMENT
There being no further business to discuss the special workshop of the Delano City Council/Economic Development Authority of Tuesday, October 29, 2013 was adjourned at 9:18 p.m.

CITY OF DELANO
ORDINANCE 0-13-01
ORDINANCE ANNEXING LAND LOCATED IN FRANKLIN TOWNSHIP, WRIGHT COUNTY, MINNESOTA PURSUANT TO MINNESOTA STATUE § 414.033 SUBDIVISION 2(3) PERMITTING ANNEXATION BY ORDINANCE
THE CITY COUNCIL OF DELANO ORDAINS:
Section 1. The City of Delano has received a petition for annexation by ordinance from all the property owners of the land legally described on Exhibit A and depicted on Exhibit B (the “Property”).
Section 2. The Property abuts the City of Delano, consists of 97 acres, and is not presently served by public wastewater facilities or public wastewater facilities are not otherwise available.
Section 3. The Property is deemed to be urban or suburban in character or about to become so. The property is not located within a flood plain or shoreland area.
Section 4. The Property is not contiguous to any property previously annexed with the precedding 12 months.
Section 5. The City of Delano has held a public hearing regarding annexation of the Property and given 30 days written notice of the public hearing by certified mail to Franklin Township and to all land owners within and contiguous to the Property.
Section 6. The Property is appropiate for annexation to the City of Delano pursuant to Minnesota Statue §414.033, Subd. 2(3)
Section 7. The Property is hereby annexed to the City of Delano.
Section 8. Property taxes payable for the Property shall continue to be paid to Franklin Township for 2013. If this Annexation becomes effective on or before August 1, 2013, the City of Delano shall levy on the Property beginning in 2013. If this Annexation becomes effective after August 1, 2013, the City of Delano shall levy on the Property beginning in 2014.
Section 9. Pursuant to Minnesota Statue §414.036, the City of Delano shall provide a one time reimbursement to Franklin Township of two and one half (2 1/2) times the property tax payable to Franklin Township for the year 2013. This reimbursement shall be made in two equal payments, the first of which shall be paid to Franklin Township no later than December 31, 2014, and the second of which shall be paid no later than December 31, 2015. This reimbursement shall be in addition to, and not in lieu of, property taxes received by Franklin Township pursuant to Section 8 herein.
Section 10. The City Clerk shall file this Ordinance with the Chief Administrative Law Judge of the State of Minnesota, Franklin Township, and the Wright County Auditor.
Section 11. This Annexation Ordinance shall be final on the date the Ordinance is approved by the Chief Administrative Law Judge of the State of Minnesota.
Section 12. This Ordinance shall be published in accordance with law.
Adopted by the mayor and council of the city of delano, minnesota this 19th day of February, 2013.
