Request for Proposals: Sale of Five (5) Residential Parcels of Land Becker 2nd Addition

The City of Delano and Delano Economic Development Authority (collectively the “City”) are seeking proposals for the purchase and development of five single family parcels of land located on Merriman Drive within the Becker Second Addition. These parcels will be sold for residential development. The parcels may be purchased individually or collectively.
The parcels are identified on attached Exhibit A. The parcels are each approximately 0.33 acres and are zoned R-2, Single Family Residential. City utilities available to each parcel are as follows: natural gas; telephone; electricity; sanitary sewer and water. The parcels are being sold “as is”. The City makes no warranties or representation with respect to the parcels except as set forth in the Purchase Agreement attached as Exhibit B (“Purchase Agreement”).
Written proposals must be received by July 31, 2017, at Delano City Hall, 234 2nd Street North, by 4:00 pm CDST to be considered.
Applicants may submit more than one proposal as follows:
• Proposal Option 1: A proposal for an individual parcel (applicants may submit individual bids on more than one parcel); and/or
• Proposal Option 2: A proposal for the collective purchase of all five parcels in one transaction.
All proposals must include the following:
• Proposals must be submitted on the Proposal Form attached as Exhibit C.
• Proposals for an individual parcel must identify the specific parcel for which the proposal applies by address.
• Proposals must include the price applicant proposes to pay for the parcel(s) and the terms of payment, if any.
• Proposals must include a time frame for construction of a residence on the parcel(s) and application for a certificate of occupancy.
• Each proposal must be accompanied by a certified check or cashier’s check in an amount equal to 5% of the total proposal price as described below (“Escrow”).
Proposals shall be enclosed in a sealed opaque envelope with the name of the RFP and name of the applicant on its face. Proposals received after the time and date for receipt will be returned unopened. The applicant shall assume full responsibility for timely delivery at the location designated for receipt of proposals. Oral, facsimile, electronic-mail, telephone or telegraphic proposals are invalid and will not receive consideration.
Submission of a proposal indicates acceptance by the applicant of the conditions contained in this request for proposals and all exhibits. By submitting a proposal each applicant acknowledges responsibility for all charges and fees set forth in the Purchase Agreement and attached Agreement Relating to Infrastructure Fees and for all other costs related to the parcel(s). The City will not be responsible for expenses incurred in preparing and submitting the proposal.
Questions should be directed in writing to Phil Kern at firstname.lastname@example.org. Interpretations, corrections and changes to the request for proposals will be made by written addendum posted on the City’s website (www.delanomn.us). Interpretations, corrections or changes made in any other manner will not be binding. Each applicant shall ascertain prior to submitting a proposal that it has received all addenda issued. Applicants shall not contact any City staff other than the representative identified above with any questions or inquiries. Unauthorized contact with any personnel of the City may be cause for rejection of the applicant’s response. The decision to reject a proposal is in the City’s sole discretion.
Each proposal shall be accompanied by a certified check or cashier’s check in an amount equal to five (5%) percent of the proposal price and made payable to the City. Should the applicant refuse to execute the Purchase Agreement or Agreement Relating to Infrastructure Fees or refuse to comply with the terms thereof, the Escrow shall be forfeited to the City as liquidated damages, not as a penalty. By submitting a proposal, the applicant agrees that said liquidated damages shall cover only the damages sustained by the City from additional administrative costs, expenses of re-advertising and rebidding, but shall not preclude the City from claiming damages on account of delay, price changes, loss of other contracts, loss of income, inability of the City to fulfill other contracts, loss of other benefits of this contract, or other direct or consequential damages arising out of breach of the Purchase Agreement or failure to perform same by the successful applicant.
The City shall retain the Escrow from the successful applicants and the Escrow shall be applied to the purchase price as earnest money as set forth in the Purchase Agreement. The City shall return the Escrow of all unsuccessful applicants within 15 days of the proposal opening.
Award or Rejection of Proposals.
It is the intent of the City to select the proposal(s) that are in the best interests of the City. The City is not obligated to select the highest priced proposal(s). The City shall have the right to request additional information or clarifications from applicants, to allow corrections of errors or omissions, and to waive any defects or technicalities in any proposal(s) received. The City shall have the right to reject any or all proposals, to reject a proposal not accompanied by the required Escrow or by other data required by the request for proposals, or to reject a proposal which is in any way incomplete or irregular. The City shall have the right to re-advertise for new proposals. No proposal may be withdrawn after the Proposal Due Date for a period of 60 days.
Execution of Purchase Agreement
The City shall issue written notification of award(s) to the successful applicants. The successful applicants shall execute the Purchase Agreement and return it to the City within ten (10) calendar days of the date of notification of award.
It shall be understood that all proposals, responses, inquiries, or correspondence relating to or in reference to this request for proposals, and all reports, charts and proposal or referencing information submitted, shall become the property of the City, and will not be returned. The City is subject to the Minnesota Government Data Practices Act, Minnesota Statute Chapter 13, and all information submitted is public unless classified by statute, or temporary classification or federal law as nonpublic or protected nonpublic, or with respect to data on individuals, as private or confidential.
