Winsted City Council Minutes


April 16, 2002

City Hall

7:00 PM

Present: Don Guggemos, Tom Wiemiller, Gary Lenz, Tom Ollig, Bonnie Quast

Staff: Attorney Eggert, Administrator Mareck, Clerk Zachmann

Mayor called the meeting to order.

Ollig motioned to accept the minutes as presented, Quast seconded, unanimously carried.

Quast motioned to table the Over time Policy, Wiemiller seconded, unanimously carried.

Discussion related to the South Lake Ditch and the Gutzmann's, was reviewed with Attorney Eggert. Eggert will contact Gutzmann Attorney for answers to questions from Council.

Fire Chief Herbolshiemer was present to request action on a newly revised Mutual Aid Agreement for Fire Depts in McLeod County, and also a Resolution Authorizing Mutual Aid and Participation in the Minnesota Mutual Aid Program. After discussion, Ollig motioned to approve the McLeod County Fire Mutual Aid Agreement, and to adopt Resolution No. 383, Authorizing Mutual Aid and Participation in the Minnesota Mutual Aid Program, Wiemiller seconded, unanimously carried.

Herbolshiemer also requested direction on assisting Social Services to inspect new licensed day care providers. That work was previously done by the State Building Inspector and has been discontinued After review of the process, Ollig motioned to authorize Fire Chief, or his/her designee, to do inspections for the fire protection area we serve, with no fee at this time, Quast seconded, unanimously carried. Chief will contact other departments as to fees, and get back to Administrator.

Recreational fires were also brought to the Council's attention. A proposed permit system was handed out to Council. The permit would also consist of regulating the fires. After review and comments, Ollig motioned to approve the policy for recreational fires within the City, providing there is no conflict with the existing Ordinance, Lenz seconded, unanimously carried.

Members of the Winsted Historical Group was present to discuss with the Council, a display for the City at the McLeod County Museum. Lenz motioned to pay all costs, as submitted, not to exceed $1,000., Quast seconded, Wiemiller abstained, motion carried.

Bill Gilk, owner of Winsted on the Lake was present with the proposed 4th Addition to Winsted on the Lake, which would include 12 additional lots. After discussion, and with recommendation from the Plan. Comm., Lenz motioned to approve the 4th Addition of Winsted on the Lake, Quast seconded, unanimously carried.

Upon request from the County Auditor, Lenz motioned to adopt Resolution No. 382-04-19-02, Reestablishing of Unchanged Election

Precinct Boundaries, Wiemiller seconded, unanimously carried.

Administrator Mareck had received three quotes for lawn care. Due to the quotes not being comparable, Ollig recommended to get quotes on a per cut basis, with a " not to exceed" clause, from May l s' thru Nov. 31 S', and to instruct Mareck to accept the quote that is in the best interest of the City, ratifying by Council, such agreement at the next meeting.

A proposed purchase agreement with Waste Management for 8.29 acres at the Industrial Park was reviewed and discussed. No decision has been made by the McLeod County Board as to abatement, although that does not affect the Agreement. Lenz motioned to empower the Mayor and Clerk to sign the Real Estate Exchange Agreement with Waste management, adding to the agreement the hazardous waste clause for each property currently owned, Quast seconded, unanimously carried.

A request for adjustment to a utility bill from a customer due to absence from the home and a broken water softener was denied by council. The policy from past will stand, that no adjustment can be made, since the water and the wastewater is treated and the city does incur costs for said utilities. Lenz motioned to deny the request for adjustment to the utility bill of Art Guggemos, Ollig seconded, Guggemos abstained, motion carried.

Quast motioned to pay the following bills:

General Chks. 3923-3972 $56,736.62

Chks. 10518-10520 $6,257.62

Payroll Chks. 4218-4238 $13,301.56

Fire Dept. Chks. 3659-3662 $459.54

Wiemiller seconded, unanimously carried.

Quast motioned to adjourn, Ollig seconded, unanimously carried.
