1)            Mayor Stotko called the meeting to order at 6:00 p.m.

 

            a)            The Pledge of Allegiance was taken.

 

2)            Consent Agenda

           

Mochinski motioned to adopt the Consent Agenda as presented.  Wiemiller seconded.  Motion carried 4-0.

           

a)              Minutes – City Council Work Session – August 19, 2008

 

Accepted the minutes of the City Council Work Session of August 19, 2008.

 

b)              Minutes – Regular City Council Meeting – August 19, 2008

 

            Accepted the minutes of the Regular City Council Meeting of August 19, 2008.

c)      Amendments – Community Room Use Policy

Approved amendments to the community room use policy.

 

d)      Appointment – Amanda Zeidler – Utility Billing and Payroll Clerk

 

Authorized the hiring and appointment of Amanda Zeidler to Utility Billing and Payroll Clerk at $14.16 an hour based on a unanimous recommendation from the Hiring Committee.

e)            Canvassing Board Members

Established a Canvassing Board with the following members:  Tom Wiemiller, Dave Mochinski, Brent Mareck, and Deb Boelter.  The purpose of the Canvassing Board will be to review the November 4, 2008 General Election results.

f)      Canvassing Board Meeting – November 5, 2008

Scheduled a Canvassing Board meeting on Wednesday, November 5, 2008 at

4:45 p.m. in the Council Chambers to review the November 4, 2008 General Election results.

g)      Meeting Reschedule – City Council Work Session – November 5, 2008

Authorized the City Council Work Session, scheduled for November 4, 2008, to be rescheduled for Wednesday, November 5, 2008 at 5:00 p.m., due to the General Election.

h)      Meeting Reschedule – Regular City Council Meeting – November 5, 2008

Authorized the Regular City Council Meeting, scheduled for November 4, 2008, to be rescheduled for Wednesday, November 5, 2008 at 6:00 p.m., due to the General Election.

 

i)      Appointment – Mary Wiemiller – Temporary Administrative Assistant

 

Authorized the hiring and appointment of Mary Wiemiller to part-time temporary Administrative Assistant at $10 per hour.

 

j)      Appointment – Gayle Detert– Temporary Administrative Assistant

 

Authorized the hiring and appointment of Gayle Detert to part-time temporary Administrative Assistant at $10 per hour.

 

k)     Salary Step Increase – John Schlechter

 

Authorized a salary step increase for John Schlechter based on the recommendation of the Public Works Leads.

 

l)       Claims

 

Approved the Claims List for September 2, 2008 as presented.

 

            Special Presentations:

 

            a)            Winsted Pride Awards

                        Mayor Stotko presented the Winsted Pride Awards to the following:

            1.            Adult Training and Rehabilitation Center – Business Winner

            2.            Lisa Hagen – Residential Winner

            3.            Dave and Katie Donahue – Residential Winner

 

b)            Boelter introduced Amanda Zeidler, newly hired Utility Billing and Payroll Clerk.

 

c)            Progress Report City Hall and Lakefront Promenade – Greystone Construction Company

 

Brett Comstock and Jim Zeck, Greystone Construction Company were in attendance at the meeting and discussed the following items with the City Council:

Ø     Lakefront Promenade asphalt will begin to be installed on Wednesday, September 3, 2008.

Ø     The Landscaping Contractor is scheduled to begin the landscaping on Monday, September 8, 2008.

Ø     Gave updates on the completion of the outstanding punch list items to be finished the week of September 8, 2008.

 

Mochinski asked when all the punch list items will be finished.  Comstock stated that they will be finished by Friday, September 12, 2008.

 

Zeck stated that he will be scheduling training for the city’s Public Works Department on all the heating, cooling and other systems in the new city hall.

 

3)            No Public Hearings.

5)            New Business

a)              Public Nuisance – Lake Trail

 

Mareck stated that four (4) properties built by Family One Builders have failed to create an established yard within a year of their certificate of occupancy.  These properties are part of an association and consequently the homeowner is not responsible for yard establishment.  The association is operated by Family One Builders and the construction was also conducted by Family One Builders.  This issue has been discussed with Family One Builders on numerous occasions and they have failed to comply with the city’s requirement.

 

Mareck stated that the costs of $11,350 associated with the abatement of this nuisance would be assessed to the property.  

 

Quast motioned to certify that 477, 479, 481 and 483 Lake Drive are being maintained as a public nuisance and further ordering that the nuisance is abated immediately by the City of Winsted and costs associated with the abatement be assessed.  Wiemiller seconded.  Motion carried 4-0.

 

Wiemiller motioned to authorize Alan’s Lawn and Landscape to perform the work necessary to abate the public nuisance at 477, 479, 481 and 483 Lake Drive for $11,350.  Mochinski seconded.  Motion carried 4-0.

 

b)              2009 Preliminary Tax Levy – Resolution R-08-19

 

Mareck stated that the city must certify a preliminary levy to McLeod County by September 15th, 2008.  Over the last couple of months, the City Council has reviewed draft budgets and levy totals; arriving at a preliminary levy of $1,065,225.  The 2009 preliminary levy of $1,065,225 is a 5.3% ($53,852) increase over the 2008 certified levy.  The preliminary levy can be cut after September 15th, 2008 but cannot be raised.

 

To date, McLeod County has been unable to furnish the city with any estimated tax capacity numbers for the City of Winsted.  These calculations will be critical in determining the impacts of the tax levy and meeting the City Council’s goal of creating minimal tax impact on property owners.  Based on the calculations, the proposed 2009 budget may be revised to meet the City Council’s tax impact goals.    

 

The city will hold a truth-in-taxation hearing on the preliminary levy in December, 2008 and then set the certified levy for 2009.

Mareck presented the following options for the City Council to consider:

1.     Set preliminary levy at $1,082,143, which creates a proposed increase of $70,770 over the 2008 certified levy (6.9%).

2.     Set preliminary levy at $1,065,225, which creates a proposed increase of $53,852 over the 2008 certified levy (5.3%).

 

Mochinski asked if the City Council cannot raise the preliminary levy but we can lower it, why would we not want to adopt the 6.9% increase.

 

Quast stated that taking past experience into consideration she would like to see the preliminary tax levy increased at 6.9%.

 

Wiemiller stated that he would like to see the preliminary levy increased to 6.9%.  It would provide the city with additional funding in the event that the city’s Local Government Aid (LGA) received from the State of Minnesota is decreased.

 

Mayor Stotko stated that he would also like to see a 6.9% increase in the preliminary levy.  With the State of Minnesota budget in the situation that it is, the city may not be getting the LGA that they are expecting.

 

Mochinski motioned to adopt Resolution R-08-19 certifying the 2009 preliminary tax levy in the amount of $1,082,143.  Quast seconded.  Motion carried 4-0.

 

6)            Department Report

           

a)              Chad Engel, Winsted Volunteer Fire Department Chief, reported on the following:

Ø     Currently the Winsted Volunteer Fire Department roster is full with thirty (30) members and one (1) on the waiting list.

Ø     There is one (1) firefighter on a leave of absence until October, 2008 and another firefighter requesting a one (1) year leave of absence to begin September 2, 2008.

Ø     As of August 31, 2008, the Fire Department has responded to seventy-four (74) medicals, thirty-two (32) fires and other type of calls.

Ø     Spaghetti Dinner and Pancake Breakfast fundraiser.

Ø     Provided fire protection for Winstock and Higher Ground music festivals.

Ø     Vehicle repairs.

Ø     Obtaining quotes for seven (7) sets of turn out gear.  This is a budgeted item.

Ø     The Annual Fire Board meeting scheduled for September 4, 2008 at 6:30 p.m.

Ø     A committee of firefighters and city staff is being formed to update and revise the Winsted Volunteer Fire Department’s by-laws.

Ø     Preparing for Fire Prevention week.

I.            Call To Order

 

Mayor Stotko called the meeting to order at 5:00 p.m.

 

II.            Updates

 

            Mareck gave updates on the following:

 

A.             The City Hall Flagpoles

 

The Council discussed and agreed that the architect, Cuningham Group, should be billed for the expense of taking the flagpoles down and cutting them off.

 

B.             Winsted Municipal Airport insurance requirements and the compliance of the hangar owners.

 

C.             Public nuisance, 163 Main Avenue West.

 

D.             Community room tables.

 

E.             Lakefront Promenade asphalt installation.

 

F.              Agenda items to be discussed at the Wednesday, September 3, 2008 Planning Commission meeting.

 

G.             Historical pictures for City Hall.

 

H.             The City Hall open house.

 

I.               Historic City Hall

 

Todd Colonna is working on the Historic City Hall but he is not responding to telephone calls from Mareck to schedule the required inspections.

 

J.              Senior Dining program will begin in the Vollmer Room on Monday, September 15, 2008.

 

K.             Winsted Volunteer Fire Department’s Annual Fall Fire Board meeting scheduled for Thursday, September 4, 2008 at 6:30 p.m.

 

L.              The proposed 2009 preliminary tax levy.

 

 

 

 

           

III.            Home Foreclosures

 

Council Member Quast asked that the City Council consider what they want to do with the maintenance of the homes in foreclosure located in the City of Winsted.  The City Council discussed options.

           

IV.            Entrance Sign

 

Mochinski reported that he contacted AHO Construction regarding the installation of the Entrance sign on their property.  AHO Construction recommended that the city contact another property owner because the property is currently in dispute.  The City Council recommended that Mareck contact RAM Building, Incorporated regarding the installation of the Entrance sign on their property.
