Winsted City Council Minutes
April 6, 1999
Present: Floyd Sneer, Bob Kegler, Gary Lenz, Tom Wiemiller, Jeff Albers Staff: Attorney Eggert, Aaron Reeves, Betty Zachmann
Others present Members of the Fire Dept., Winsted Township, Winsted Police Dept., other interested parties.
Mayor called the meeting to order.
After review, Kegler motioned to approve the minutes of Mar. 16 as written, Albers seconded, unanimously carried.
Wiemiller motioned to approve the job description of the Public Works Supervisor as written, Albers seconded, unanimously carried.
Mike Larson, Winsted Police Officer presented to the Council, a Weight Equipment Proposal for the Police and Fire Depts, including the site to be at the Fire Hall. The plan included a process for use, waivers, hold harmless agreements and hours available. Council discussed risk, liability on the part of the City, costs, training and hours. After discussion Lenz motioned to do a 6 month trial, requiring two persons present when used, allow use 24 hours a day, fencing and securing the area in the Fire Hall, and all users signing a waiver which shall be approved by the Council, Wiemiller seconded, unanimously carried.
Mike Fiecke was present to request ditch area be placed back to its original condition prior to construction in 1997. Reeves will have this done either by the contracter or the City.
The City received notice from the League Minn Cities Ins. Trust, that it will be required to pay 15%, or $ 12,990.07 for legal fees in the lawsuit that was brought against the City by of SJF, Inc. No action was taken
Wiemiller motioned to pay the following bills:
Check Nos. 9202-9259 $107,274.61
Payroll Nos. 2958-2981 $ 13,175.76
Fire Dept. Nos. 3132-3138 $ 1,726.68
Albers seconded, unanimously carried.
Permission was granted for a business to place benches in front of his property for the summer months only, and any problems or injuries are his responsibilities.
Kegler motioned to approve tobacco licenses for: Glenn's Super Valu, Keg's Bar, American Legion, Bailey's, Tom's Corner Bar, Blue Note, Tom Thumb Market, Casey's Conv. Store
Lenz seconded, unanimously carried.
Request for a desk for Police Chief, which was over budget was approved. The new squad is in, the Council opted to not purchase the extended coverage on the vehicle.
Kegler motioned to remove from the part time Officer roster Thompson and Galles, and add Dave Anderson and Ryan Moonen, Albers seconded, unanimously carried.
Winsted Township Supervisors were present with questions related to the Township Office, concerns were resolved.
Resignation of Sec/payroll clerk LouAnn Laxen was accepted. After discussion, Kegler motioned to not hire another part time, to offer the position as full time to Rose Halloran, Albers seconded, unanimously carried. (Halloran was present and accepted)
Triax Cable franchise was discussed. Silver Lake, Lester Prairie and Winsted are working together to address the complaints regarding service. After discussion, Lenz motioned to approve a maximum of $4,000.00 for legal fees, to hire Bernick & Lifson to negotiate a new franchise with recommendations from the Cable Board, Kegler seconded, unanimously carried.
There was discussion regarding the sale of the first lot in the Industrial park, improvement costs, access and payback through taxes. No action was taken.
Since the City will be selling bonds for several improvements including seal coating and replacement of curb and gutter, it was decided to proceed with under Chapter 429, with Public Hearings, etc for sale of bonds.
Lenz motioned to adopt Resolution No. 305-04-06-99, accepting the Petition for Annexation of land owned by Rita Littfin, located on Baker St. E., Kegler seconded unanimously carried.
Lenz motioned to enter into an Agreement with Henry Poshek, to allow bituminous on an alley, full costs to him, with no maintenance or obligation on the part of any utility entity to restore to original condition, any portion of the alley, should the need arise to do maintenance or repairs within the alley right of way, Kegler seconded, unanimously carried.
Albers motioned to adjourn, Kegler seconded, unanimously carried.
