Winsted City Council Minutes


JUNE 2, 1998


7 P.M.

Present: Bonnie Quast, Gary Lenz, Bob Kegler, Mark Ollig, Attorney Eggert

Absent: Don Guggemos

Deputy Mayor called the meeting to order.

Kegler motioned to approve the minutes as written, Lenz seconded, unanimously carried.

Review and discussion took place regarding the water issue at 521 5th St. No. Jeff Quast was present requesting a change to the water flow of the neighbor, as water was standing in the swale. He stated that the water was collected from 96 sq. ft of roof run off, and he never had water on his north side before the garage construction.

He presented pictures showing the water in the swale during the storm. It was also agreed there was 1 inch of rain Friday and Saturday nights, during the time the pictures were taken. Bonnie Quast questioned why the tile wasn't pursued. Gary Lenz stated, although it was suggested, because of the storm sewer and I & I process that may not be possible, with no storm sewer to tap into in that area, and the City in the process of a study.

Lenz stated upon review of the site on Saturday by several Council members (Gary Lenz, Bob Kegler, Mark Ollig of the Council), Clerk Betty Zachmann, and in discussion representation of both owners present), with reconstruction and moving of the gutter that had taken place, the established swale between the properties upon completion of landscaping, the pre-existing elevation conditions of that area in general it was Council's opinion, the water would not be a problem, following the flow of the swale to the street.

Those present agreed that there was no damage to property since construction, with wash-out of soil being done during construction due to a rain.Upon discussion, Bonnie Quast, by suggestion from Jeff Quast, directed the Clerk to contact Neuman and suggest the gutter be moved from the SE corner of garage to the NE corner of garage.

(NOTE: Prior to the Council meeting, an EDA meeting was held, and adopted was Resolution No. 283-06-02-98, Requesting the City Council of Winsted call for a Public Hearing on the Modification of the Residential Development District and Modification of the Tax Increment Financing District No. 4.)

Kegler motioned to adopt Resolution 284-06-02-98, Calling for a Public Hearing by the City Council on proposed adoption of the modification to the Development Program for Tax Increment Residential Development District No. 4, and proposed modification to the Tax Increment Finance Plan, Lenz seconded, unanimously carried.

Kegler motioned to adopt Resolution No. 286-06-02-98, establishing a penalty for non-compliance of clear water discharge into sanitary sewer Ordn. 98-03, Ollig seconded, unanimously carried.

Council members viewed the County Rd 1 construction (Also known as old Hwy 261) on Saturday morning because water had been witnessed. Water was standing in several areas at the intersection of Main and 6th St., due to the fact that water could not get to catch basins with the current blacktop.

The opinion of that intersection was unacceptable to the Council. The meeting of the new and old street on Main Ave intersection, build up of road bed and "hump" on the west of that intersection, and "dip" east was also disappointment by members. The issue had been brought up before, and relayed to the County and engineers. The County was contacted regarding the issue.

Discussion centered around alley complaints. Blocking of alleys for more than 30 minutes is in direct violation of Section 4, 504.001 S, Zoning Ordinance. Additional information will be gotten for possible expansion of this section.

Attorney Eggert informed the Council that the City would have the option to hire Cable experienced Attorneys to assist in franchise renewal negotiations. The City will request the Cable Commission become active.

NSP representatives will be present at the next meeting to discuss the power outage on the north end of the City.

Additional information will be gotten related to traffic complaint on 1st St. So and McLeod.

Review of McLeod County Variance of Kerber, and final plat of Bayerl were noted that the City has no objection to either request.

Fire hall construction will begin soon. In a joint effort, Larry Biske, firemen and Don Guggemos, Mayor will be the contact for the entire construction project.

Lenz motioned to pay the following bills:

Checks 8144-8180 $38,469.55

Payroll. 2649-2663 $8,795.54

Fire Dept. 2983-2988 $ 5,960.82

Kegler seconded, unanimously carried.

Lenz motioned to approve a Dance Permit to the Blue Note of Winsted for one year, Kegler seconded, unanimously carried.

Lenz motioned to adjourn, Ollig seconded, unanimously carried.
