Wright County Board Minutes
DECEMBER 17, 2002
The Wright County Board met in regular session at 9:00 A.M. with Mattson, Eichelberg, Sawatzke, Jude, and Russek present.
Eichelberg moved to approve the minutes of 12-3-03, seconded by Mattson, carried 5-0.
Petitions were accepted to the Agenda as follows: Item For Consid. #3, "Refer To Committee Discussion RE: Possible Purchase Of Building" (Norman). Eichelberg moved to schedule a Committee Of The Whole Meeting for 1-7-03 at 10:30 A.M., seconded by Jude, carried 5-0. On a motion by Jude, second by Eichelberg, all voted to approve the Agenda as amended.
The Consent Agenda was amended as follows: Item E1B should read, "Approve Request To Rezone From AG & S-2 To R-1 & S-2 For Riparian Lakeshore Lots & R-2 & S-2 For Remainder Of The Property, Donald, David & Larry Maki (Corinna Twp.)" (Salkowski). On a motion by Mattson, second by Sawatzke, all voted to approve the Consent Agenda as amended:

1. Accept The Findings & Recommendations Of The Planning Commission For The Following Rezonings:

B. Approve Request To Rezone From AG & S-2 To R-1 & S-2 For Riparian Lakeshore Lots & R-2 & S-2 For Remainder Of The Property, David, Donald & Larry Maki (Corinna Twp.).
1. Acknowledge Resignation, Tamara Everett, Communications Officer, Eff. 11-22-02 & Authorize Replacement.
2. Authorize Signatures On RF Control Stations Agreement.
3. Refer To Personnel Committee Discussion RE: Moving Hire Date Of One Position Authorize For
7-1-03 Up To 2-1-03 To Cover For Deputy On Military Leave.
Bob Hiivala, Chief Deputy Auditor, presented the claims listing for approval. Hiivala said that the claim to Software House International, Page 15, will be reviewed by the IT Director to determine whether payment will be made. The claim will be pulled and if it is determined that it should be paid, it will be part of the next meeting's claim listing. Eichelberg questioned a claim on Page 4 to Pakor ($2294.89) for a passport camera. Hiivala explained that this purchase will allow the License Bureau to perform the function of passport photos where in the past this had not been done. Russek referred to Page 5 for a claim for $1400 to the Highway Department for maps. Hiivala explained that the Auditor's Office purchases maps from Road & Bridge for resale. On a motion by Mattson, second by Eichelberg, all voted to approve the claims as listed in the abstract, subject to audit.
On a motion by Jude, second by Sawatzke, all voted to approve the Truth In Local Taxation Minutes from 12-5-02.
Brian Asleson, Chief Deputy Attorney, referenced Board action approximately one month ago terminating an agreement with Sherburne County for the storage and maintenance of the River Rider Bus. Asleson presented for approval a Joint Powers Agreement with Sherburne County. The Highway Engineer has reviewed and approves the Agreement. The Bus will be stored in the new facility in Big Lake during the winter months and at the Public Works site during the summer months. Jude moved to authorize signatures on the Agreement, seconded by Mattson, carried 5-0.
Asleson presented a draft resolution which would convey County Ditches 9 & 21 to the Cities of Albertville and St. Michael. In 2000, the Minnesota Legislature passed special legislation providing for this action. Both cities have taken the necessary action. Mattson said he hoped the Cities involved would recognize the farming community while dealing with water issues. Asleson responded that very minimal ag land is involved. Jude noted that the County is transferring responsibility of the ditches, not changing the rules which apply to them. Eichelberg moved to adopt Resolution #02-69 conveying County Ditches 9 and 21 to the Cities of Albertville and St. Michael, seconded by Jude, carried 5-0 on a roll call vote. A second motion relating to the conveyance of these ditches was made on a motion by Eichelberg, second by Mattson, carried 5-0. After review of the documents, the second motion was rescinded on a motion by Eichelberg, second by Jude, carried 5-0, as conveyance of both ditches was included with the adoption of Resolution #02-69.
A draft resolution setting the 2003 Certified Taxable Levy and 2003 Budget was presented for approval. Mattson referenced the positions included in the Budget with a 7-1-03 hire date and said that he brought up a hiring freeze in December. He felt the freeze should be in effect due to the State's budget deficit. Russek said the County would have that option until July. On a motion by Jude, second by Eichelberg, all voted to adopt Resolution #02-70:

Tom Salkowski, Planning & Zoning Administrator, brought forth a recommendation from the Planning Commission (6/1 vote) for denial of a rezoning request to rezone from AG to A./R, Todd Lewis (Clearwater Township). Todd Lewis explained that his request is associated with an attempt to financially assist a relative through rezoning. This rezoning would also allow Lewis and his wife to build on the acreage. Lewis said the land to the north of this property is zoned for 2.5 acre lots. It was explained that the property is not included within the Land Use Plan recently updated by Clearwater Township. Salkowski said Plans normally aren't updated annually and felt it may be a few years before it would be revisited again. Sawatzke moved to accept the recommendation of the Planning Commission and to support the denial of the request, seconded by Mattson, carried 5-0. Salkowski provided Lewis with a Notice and Order of Denial.
Wayne Fingalson, Highway Engineer, introduced Richard Walters, the Executive Director of the MN Asphalt Pavement Association. Walters presented a 2002 Merit Award for Construction Excellence for the CSAH 39 Project to Buffalo Bituminous and the following members of the Wright County Highway Department: Virgil Hawkins, Kevin Johnson, Wes Workman, Dave Pullis, Pete Forare, Bill Cordell and Bill Augustin. The project competed with projects from throughout Minnesota. The CSAH 39 project runs from CSAH 8 to 3rd Street in Monticello.
On a motion by Mattson, second by Eichelberg, all voted to approve a Partnership Agreement with Mn/DOT, authorizing the County Engineer to execute the contract. This agreement will allow funds to be reimbursed directly to the District Office performing the work instead of to the Central Office. Example services will include materials testing, bridge maintenance services, box culvert inspection, and pavement condition data.
On a motion by Jude, second by Eichelberg, all voted to adopt Resolution #02-71 requesting the Commissioner of Transportation to perform a speed zone study on CR 119 in St. Michael. This was prompted by a request from the City of St. Michael.
On a motion by Sawatzke, second by Mattson, all voted to adopt Resolution #02-72 requesting the Commissioner of Transportation to perform a speed zone study on CSAH 42 from the City of Dayton to the City of Elk River. The segment is currently zoned at 55 mph and was prompted by citizen calls. A school was recently built in this area.
Mattson moved to approve Agreement No. 02-04 with the City of Montrose for CSAH 12 improvements, moving the project up in the schedule at the request of the City. The City has approved the Agreement and the originals will be forwarded to the County once signed. The motion was seconded by Sawatzke and carried 5-0. In response to a question by Sawatzke, Fingalson stated the bike trail will be included in the next phase of the project.
